No one is attacking you because you stand up for something.  We are tired of your whiney comments and wish you would change the tape or tap the phonograph so the record will QUIT skipping.  Talk about beating a dead horse.   Go find those artists will ya and get away from collarme since everyone, no matter what they do is wrong in your eyes.

wow this went from fun to freakin stupid in a page or two didn't it?  Well...everyone wants to be able to grab a post quickly based on the pic or avatar and here I am I just changed mine again....wonder if I should go back to the red corset and boot picture....

It’s an interesting debate the copyright issue. Can you copyright a picture of a tree or an insect? Does copyrighting a picture of a tree mean no one else can take a similar picture of a tree? Wallmart recently tried to copyright the smiley face. I’m all for giving people credit for the things they do but I feel sometimes it goes a little too far and you can’t live off of one good idea for the rest of your life.

If Mark Twain was still alive would he be taking legal action if I didn’t credit him with the above quote?

Of course you can. It's an artwork, a piece of intellectual property, and the copyright rests with the photographer or artist, unless they assign it to somebody else.
However the copyright is in the picture, not the subject.    Anyone else is free to take another picture of the same subject, and the copyright in that picture will be theirs.  If you were to set out to copy the original picture precisely, that might be open to question, especially if you did it for commercial gain.

It would be hard to prove intent or that I had even seen the original in some cases.

What I meant by the Mark Twain quote was; it’s easy for him to say things like that when it isn’t personal to him. If I had not put it in the form of a quote and claimed it for myself he would not be best pleased I expect

It never ceases to amaze me when it is clear that you won't change someones mind that people keep trying to do just that.

Fees have been paid. Artists have been compensated. Avatars for sale have been offered as such by the artist themselves or through a "broker" with the artists expressed permission. This means simply that any avatars that may actually be in violation of copyright laws would make the entity that sold the avatars liable for infringment... not this site.

Instead of making a Federal case out of this, why not simply work with the site owners and point out the artwork that you claim they have no permission from the artist to use. I am sure that the site owners will instantly remove anything that should not be there.

Rather than being reactive be proactive and do something other than clutter up the boards repeating the same tired diatribe all over again.

First of all, not all art is licensed. There are also various types of licensing... for example, the artwork you get from Microsoft for their programs (Windows Messenger, Powerpoint, etc.) is licensed. If you read the Terms of Use/Agreement, you'll see that they are granting YOU the right to use the art in ways that are compatible with the usage of their programs. Sometimes, this includes sharing (on Messenger, if someone uses an emoticon, and you like it but don't have it, you can add it to your collection - this is a feature of Messenger, created by the creators of Messanger, and so expected by those creators). What you can't do is claim that the art is yours and sell it to others.

In CM's instance, the majority of the avatars are likely part of a bundled package (Facebook, MySpace, and others offer the same thing to their users), for all who are members of CM to use. Sort of like Messenger art, as per above. Also, if you read the link that BBBTBW so kindly provided, you'll see the following message:

"If you are an artist who would like to contribute more than 10 avatars of your own creation for our use please feel free to contact me on the site."


This means that artists can submit their art for others to use, as per CM guidlines. Since there seems to be quite a few new avatars popping up since I joined, I'd hazard a guess that some people *gasp!* have acutally submitte art! I doubt these artists are so naive as to think that their work won't be used by others on this site... afterall, that is what Mod1 is offering TO SHOWCASE YOUR ART AS AVATARS ON THE SITE.

I'm about done. Didn't mean for this to get so long .

Final point - if the legality of this site bothers you so much, why use it? If you are so concerned about copyright issues and being sued, wouldn't you be concerned with being charges with being an accessory? Just curious.

However you have about as much hope of said person reading this and taking it in as I have of sleeping with George Clooney. A major case of head banging I think but not in a good way. Sometimes it amazes me how a thread can take such a bad turn so quickly. But I suppose that is what make this place so interesting.
