The one thing that jumpped out at me was this guys lawyer : "I'm asking you to give him a chance based on a lifetime of work, not one incident, where something went wrong. He has done 13, 14, 15 years of good work as a police officer with commendations who deserves some consideration for that," said attorney Carmine Colucci.

Ok lets see here is he on trial for being a bad cop? Partially. He is on trial for breakign the law, he lied to a minor, drove out into the desert and sexually assualted him. If anythng because of his prefession he should really get the book thrown at him and put under the jail. No one gives as damn about what a good cop he USED to be. He crossed the line big time it snot like this is some minor incident that can be swept away. Defense attornerys kill me sometimes. I know its their job but damn

It doesn't matter what his former job or profession was.
Once he crossed the line that's it.
This is why I am a staunch advocate of the death penalty for child abusers.
And, they need to be executed *in public*.

quite frankly, i could give a rat's ass what his record was like as a cop.....the man is scum, and deserves everything he gets, and then some.  One interesting thing I noticed on his Police ID was the title of PEACE OFFICER....in many states, that's not the same thing as a cop....and right now, i'm too lazy to go see what the difference is in CA......but again, it doesn't mean jack to me.  Word will get out really quick what put him in jail, and hopefully, they'll put the bastard in the general population....he'll be someone's bitch really fast......if he doesn't get shanked in the yard!  And if they can prove that it was him that killed the kid in LA, I hope they have the death penalty there!

Modern legal codes use the term "peace officer" as an inclusionary term for every public sector person vested by the legislating state with law enforcement authority (traditionally anyone "sworn, badged, and armable" but, basically, who can arrest, or refer such arrest for a criminal prosecution). Hence city police officers, county sheriffs' deputies, and state troopers are usually vested with the same authority within a given jurisdiction.

Having been former law enforcement myself... being a cop... if anything... you should be held to a higher standard than use that as a crutch.  If that were the case, what about other people past?  I shouldnt get a harsh penalty because i was a boy scout and walked little old ladies across the street?  I should get the death penalty because I was a cashier?  Being a cop he was WELL acquainted with the law and what the penalties were for his actions... and did them anyway.

A former friend of mine was an officer of an elite squad in Florida.  After several women complained, they found that he was using his "authority" as a police officer to tell the victims of rape/sexual assault that he needed to "physically inspect" them.  All of the women this happened too were unfortunately immigrants from other countries, generally Haitian women. This man had been a very close friend for many years and i would never have suspected he would do something like this.  He was also married to an attorney in the State Attorneys office.  His attorney was pushing for a light sentence because of his record and the fact his wife was an attorney for the State. 

In both cases, they used their position to COMMIT the crimes.  Dont use the fact you are a police officer to lure victims to the slaughter... then think you can fall back on it saying you had an exemplary career.  Just because your personnel jacket doesnt reflect anything negative, does NOT mean that he was the perfect cop either.

In California, the term "Peace Officer" is anyone so recognized and certified by the State of California through the Peace Officer Standards and Training system of qualification.

Persons who appear to be peace officers in the state of California:  Highway Patrol, State Police, County Sheriff and Deputies, City Police, Marshalls, some Park Rangers, University Campus Police, and the enforcement arms of various departments such as Housing, Building and Safety, Coroner, Animal Regulation, and a host of others.  Basically, if they have the power to arrest, they are issued a Peace Officer Identification Card by the State of California, which qualifies their identification as an enforcement officer in their own agency.

seems that for every sicko that commits a horrendous crime, theres always someone on camera saying "he always seemed like such a nice guy".

i think he should be punished double because of his profession, but that would be kinda like the hate crime mentality, which i have been preaching against....

hmmmmmmmm now i went and made me think.....wheres that dang advil?

thanks for the info....not confused at all, either....read far too many procedural and penal law books in school!

Either way, i agree that as an ex-cop, he should be held to a higher standard, and equal under the law without his record as a cop being used as a consideration.  And I have seen it usually backfire in most cases where the defense has tried to use it as a defense.  Which it probably will here.....crimes against kids cause a gut, even primal, reaction in most people.  And I think the public also has the mindset of since he's a cop, he SHOULD be held accountable, and to a higher standard.......hopefully, the jury thinks the same way too.

Well as a former resident of Vegas I can say the general population is pretty smart and because it is a crime against a kid this guy is gonna be in lock soon knowing first hand what its liek to be sexually assualted. No matter the neighborhood from the ebst to the wrost there are always cops on patrol and they can be some of the best but also the worst in this case. The cops are supposed to be ones we don't have to worry about to do their job which is to protect and serve.

i dont take issue with the lawyer pointing out yrs of good service. if u ever sit in any court room, and watch, lawyers will always bring up a persons history,,whether its a young person ( gradutaed from....) or a more established person,,,(has held thier job for 17 yrs at the ......)
he is just doing what he is paid to do, try to show his client in the best light possible.
judges know this,, and so do most jurors. it carries lil weight with anyone. and wont help this gentlemen at all i suspect. to remind the jurors that he was suppose to be upholding the law(or use to) just makes him look that much worse  (thankfully..
bottom line,,,,, he will get his in the end ;)(cause thats what they do to perps with lil eyes )

The crux of the matter is that it should not make a difference what profession he was in.  We have a justice system in place to ensure that there is some sense of equality in treatment of criminals and to protect the innocent, whether it works or not.  Holding him to a higher or lower standard because of his law enforcement status would negate that system.  Convict him according to his crime, not his job.
