suppose someone shipped to you from another state items. you presumed- that what you did buy on an online auction - that- ok- they sent the whole unit - not just the part. then you get an angry phone call.  they shipped it to you by mistake....and then demand "payment"- whose property is it?

is it urs? no one seems to know.....

yes, come and shingle my house.  I didn't ask you.  tell it to the judge.  that kinda thing is a big fuck you.  if they want to ship me a return carrier and give me some shipping and handling, I might send it back at my leisure.

If they're demanding payment for something you didn't order, instead of wanting it shipped back at their cost and to send you the accurate item, I'd think something was fishy.  I'd not pay anything, but I WOULD ship it back with an email sent as soon as you ship it off saying you'd done so and formally demand the original purchase be honored or your money back, in that email, and in the shipping package itself.  (I got two things by mistake once, when I'd ordered one..the attorney I was using at that time for something else said legally the second one was mine, but I returned it of my own accord to the company.  I'd have felt so guilty had I kept it, even though it was relatively inexpensive.)

They sent the item by mistake yes, but the item still is not yours (Think of it along the lines of Banks putting cash into your account, just because it is there doesnt mean you own it and the bank willdemand the funds be returned (if you had removed/spent) when the error is discovered).

Now it is up to them to arrange for the item to be picked up or returned (it is not your fault they sent it and you have no duty to be out of pocket). If they dont arrange this in a reasonable amount of time, then they give up their rights to the item (Id suggest something along the lines of an email stating that if this item isnt arranged to be picked up within (for example) 2 months, then it will be disposed of).

There is NO way they can demand a payment for an item you did not order - this is consider unsolicited mail and you are not liable for it (I am pretty sure the USPS will be able to put your mind to rest about unsolicited items).

Possession is 9/10ths of the law. If they started out with an angry phone call, instead of an apology and hoping to win you over with kindness,  I would tell them to go tell it on the mountain...just for principle's sake.

I don't know the difference between what you ordered and what you got, in monetary value. After, all it was their mistake. But if they changed their attitude, and  expected no effort on your part, meaning expenses, maybe even time. I might consider returning it. But come on, don't come in like a bull in a china shop. Demanding payment, is over the top ! Sounds like a scam preying on people's guilt quotient.

interesting comments. the phone call was very rude and demanding.  i hung up on the caller. the call in of itself warrants a discount. on the otherhand maybe ill just send it back so as to make the matter go away. arghhhhhhhhhh!!

If the person was extremely rude for their mistake, I'd email them back stating that they pay for the return S$H fees. Give them a 7 day time limit or they forfeit the item.
