ALLENTOWN, Pa. - A federal judge on Thursday struck down the city of Hazleton's tough crackdown on illegal immigrants, ruling unconstitutional a law that has been emulated by towns and cities around the United States.

The Illegal Immigration Relief Act sought to impose fines on landlords who rent to illegal immigrants and deny business permits to companies that give them jobs. Another measure would have required tenants to register with City Hall and pay for a rental permit. It was pushed by the Pennsylvania city's Republican mayor last summer after two illegal immigrants were charged in a fatal shooting.

a terrible ruling. the well funded aclu-doesnt have to absorb the extra costs- that an increased population brings into a town. crime is up- etc.

from what i understand the ordinacne sounded logical.

so- the folks who are legal will foot the bill for the deadbeats- on the welfare rolls! add crime, gangs and drugs- and frankly...a developer wants to tripple the public housiiing units in my town. i am against. i spoke to an officer the otehr day- he said there IS gang graphitti on the one side of the river wall.
living in chicago- i know that graphitti must be coverred up right away- or it takes over everything.

if anyone has any links on how to keep gangs OUT of a small town pls post. ty

I still haven't figured out why this sort of law is unconstitutional.  Illegals are .. illegal.  If we'd stop affording them the benefits of our constitution, perhaps they wouldn't be draining our coffers?

Because of the 14th Ammendment to start with. Everyone in the US gets equal protection under the law and this ordinance violated that by trying to prevent one class of people from renting property. Also requiring everyone who wants to rent in a town to register at City Hall and pay to get a permit is a violation of a whole bunch of federal fair housing laws.

As to why do illegal immigrants get Constitutional protection? Because we have always afforded those rights to immigrants and it is only recently with hispanics arriving in large numbers outside of the south west that this has suddenly become a problem. Which is racism and bigotry of the most basic sort.

Just because something has "always been" a certain way, doesn't mean that it doesn't need to be reassessed.  I don't think all of this backlash against illegals is based in racisim or bigotry in any way.  I think the problem people have is that these people are here illegally and it's time to stop the bleeding or die of exsanguination.    Not to mention, there are more than just Mexicans crossing the border, or haven't you read about the influx of the OTM's?  I personally am the granddaughter of immigrants.  The difference being that my grandparents followed the rules.

This has nothing to do with racism or the color of their skin. This has to do with money and politics. It's that simple. The Republicans need the cheap slave labor to keep profits inflated and the Democrats need a dumb population to keep dependant on government services.

Meanwhile the average everyday American Joe is being screwed by both parties....

To start of with I am not in favor of illegal immigration.  That being said I would like to take a moment to disagree with a few of your points.  Those that are here illegally are not a net drain on our economy.  The overwhelming majority are single males they pay taxes the same as everyone else does.  That those taxes deducted from their paychecks may not be remitted to the government is the fault of the employer.  They pay property taxes through their rent but because they are mostly males without children they shoulder a disproportionate share of the cost of public schools.  They pay income tax but cannot file for any refund coming to them.  They pay unemployment insurance but can never collect.  They pay social security but can never collect.   I do like the word you used...exsanguianation...they are not bleeding us white but... damn that word just feels nice in the mouth.
As for your grandparents following the rules you might want to look at just how the U.S. acquired the land we live in.  With the possible exception of Alaska every inch of the U.S. was acquired by force of arms.  Now before you tell me that that is how all countries are formed consider that if you believe that way then that might justify Mexico invading the U.S. the way we invaded Mexico and took half of that country.
Then there is the question of the black people who are the descendants of people brought to this country illegally.  If I remember correctly the importation of slaves was outlawed in 1822.  So all those slaves brought in after that date would have been brought here illegally.  There are those who feel that there should be a law to deny citizenship to  the children born here of illegal aliens.  If that were to become law then what would we do with some thirty million Americans of African descent?
Now we get to the crux of this discussion of this law that was just overturned.  Just how does one prove ones citizenship in this country?
As far as I know a passport is probably the only document that would absolutely prove this.  What does one need to get a passport?  I believe all you need is about a hundred dollars some photos and a birth certificate you fill out a form and in a few months you get your passport.  A birth certificate does not have a picture on it.  Usually it only has some writing on it and a  tiny foot print.  If the authorities stopped you for a traffic violation and demanded you prove citizenship could you do it? I doubt that I could without taking a few days to find some corroborative evidence.
Are you in favor of a national ID card?  How would it be any more difficult to forge than a drivers license which one can buy with impunity in most any big city.
I do not know what the answer is but I do see that the problem is more involved than a bumper sticker slogan.

Well, it's still a federal felony to "hire, harbor. or shelter" illegal aliens.
So if you know that someone is in this country illegally and you rent them an apartment or hire them you've committed a federal felony.

thompson -- you really need to see the reality of the situation before you speak.  The majority are not males who work and pay taxes.  I once was employed by a company that hired illegals for our work force.  Not excusing that in any way or condoning it, it's just the way it was.  These men lived in homes converted to barracks.  They'd be deported and return in ten days with new names and new social security numbers.  It's not a new problem, it's an old problem that has grown exponentially worse because we, as a nation, tend to stick our head in the sand and believe that everyone loves us and will not harm us.  We are our own worst enemy and we need to take action to correct our oversights.

PaHunk, also, this Judge *knowing* that the Federal govt.isn't enforcing the law offered no alternatives!
He wasted his time writing a 208 page "opinion" about basically nothing!
Robbing banks is a Federal crime.
They're "F.D.I.C." insured.
Then why do local and state police get involved in Bank robbery crimes if they're Federal laws?
Would this Judge rule that local and state police can't enforce bank robbery laws?
And look at all the FEDERAL drug laws!
Local and State Police have no problem *Enforcing Federal Drug Laws!*
There is absolutely no Consistancy here or in his ruling!
He should have ruled that "unless and until the Federal govt. *does actually enforce our immigration laws* The People (Local, State) have the right to defend themselves."
And, this Judge should have issued a bench order to the Federal govt. to "do it's duty" and begin enforcing Federal Laws.
This will be overturned on appeal.
In the mean time Hazleton's *U.S. Congressman* should start swearing in all local and state Police Officers as, "Federal Law Enforcement Agents."
Then, they can start enforcing *all* Federal laws!

Where I went to grammar school I was the only anglo student until my sister became of school age then there were two of us...I might add that all the students and their parents were U.S. citizens.

I am sorry but your statement seems to be self contradictory.

The primary harm I see is being done by the politicians.

We are our own worst enemy and we need to take action to correct our oversights.
Depending on what you call oversights I am most likely with you here.  The government allows illegal aliens because it is cheaper than slavery.  If the government were to apply the same asset forfeiture laws to those who employ undocumented labor as they do to drug dealers and whores then there would not be any undocumented labor.
