I completely agree that the guy is an ass, and his wife should try to take him for all he's worth. Here comes the but..they basically just shared his personal information without his permission..not by sending the thank you note, but by faxing a copy of the receipt to his wife when she requested it. It was done over the phone, she could have been sally jones from across town lying about who she was. Companies are entirely too free about sharing that type of personal information.
 
Hypothetical..someone scopes out your mail, sees a letter from 1-800-flowers, calls the company and asks for a copy/fax of the receipt using your name or pretending to be your spouse, whatever. They then proceed to use the info from the receipt for identity fraud purposes. The victim sues the company. Would it still be such an issue? I think the guy is suing for the wrong reasons and will probably be laughed out of court, but sometimes there's a glimpse of genius in the ridiculous. Just my two cents, as always.

I heard it reported on the radio,1st. 

I think the guy specified to NOT send a receipt or confirmation, to his home address.I think that`s SOP,at most florists.

But that detail got missed and and it was sent anyway.They hire kids and part timers who couldn`t care less.

So when she got it,she called and found out.

Damn.....I hate to admit it....But the florist way over stepped the boundary....Yes, the guy was having an affair....But there are certain places one does business that privacy are a concern as well as implied....Florists, hotels and escort services to name a few....I believe that his right to privacy was ignored and he probably is going to receive some sort of judgment or settlement in his favor.

Urban myth:  There`s to many "frivolous lawsuits"

Fact:more than 50 % of frivolous lawsuits ,are brought by corporations,against other corporations.

IMO,the wacky cases get high lighted, while the righteous cases get dragged down w/ the rest.

When my exhubby was having an affair, I STILL remember when his mistress [woman he was cheating on me with] called ME up and told me that he was cheating on HER with someone else. I heard from 4 other women in 2 days, saying the SAME thing. After I finished laughing, I called parole, then filed for divorce.

Karma. Men/people who cheat DESERVE to be caught. It looks like the florest in this case had a bit of help from karma as to exposing this moron's devious and illegal activity. Affairs ARE illegal in most states.. in California we have an 'Alientaion of Affection' Law on the books. Any one who has an affair can be prosecuted for that.Its a 'karma' law. [:D]

I don't agree with cheaters, but that's my perspective, and nobody else's.

However, if a company (IF) states that it will send no further communication about a transaction, and they do, then that is a problem.  If he conducts business with them on that condition, and they breach it, they should be at least partly responsible for the repurcussions.

Not saying his actions are good, but he has a point.

Affairs are Hawt!!... haw!!...hawt!!... It shouldn't be surprising to anyone who reads these forums that you are wrong.....California like most states no longer has on the books an Alienation of Affection law......Affairs are not illegal....They are Hawt!!!

Even in the few states that have Alienation of affection laws...an affair would not automatically be an offense....Your wife might be crazy or a total cunt and deserve to be affaired upon....(affaired upon...It's got a nice ring to it)

If there was such a thing as karma it seems, from what I have read about the things that you have done, you would really be screwed!!....You should count your lucky stars, little girl.....Or tell your loved ones to steer clear of you because a big ol' lightening bolt is heading your way.

From what was writen, it seems like he sent them while he and his wife were separated, then the company sent the thank you card after she came back to him. Since she had filed for divorce and was moved out when he sent the flowers, I see nothing wrong with what he did.

I read the whole article and my amatuer opinion is that that guy wont get anything from Flowers and the wife wont' get anything from the hubby.

First of all, he can't sue the flower company on a supposition of what MIGHT happen.  He first has to suffer damages as the result of their error. 
And I doubt that will happen, because the note only proves he sent flowers to another woman, it doesn't prove that he fucked her, so who knows if the wife can even prove infidelity from this.
And even if she could,  I'm not sure that adultery carries punitive damages anymore.  I know it doesn't in New Jersey, but don't know about other states. 
And the stuff about her getting more child support because of an affair is bullshit as well.  CS is calculated very specifically to  pre-formulated state guidelines based on each parties' income and number of children.  The specific cause of action in the divorce plays no part whatsoever in the amount of child support that is paid.
