Your cop brother is sort of right, a cop can arrest you for all sorts of stupid reasons just like they can arrest you for resisting arrest even if there are no real charges.  Being arrested and being tried are two very very different things.  District attorneys throw out all sorts of cases and what they don't throw out Judges can.

Considering how few rape cases ever go to trial, even when the cops know EXACTLY who raped someone, the risk of cops screwing with you for kinky sex is pathetically low in most states.  Bible belt states where it is only acceptable for preachers to molest people are a different story, all sorts of fucked up shit happens in those backward states, things like voting for Bush and believing the earth is only 5,000 years old so they don't count.

First of all, I understand feeling very strongly about something but there is absolutely no reason to be personal or to sling insults.  Secondly, I NEVER SAID my brother arrested anyone for those reasons.  My brother is a deputy sherrif who is a correctional officer INSIDE the jail and has never actually arrested anyone!  if you had thoroughly read my post you would have seen below:

I at no time said HE made the arrest.  And IL is not the only state that has this problem.  I can't find the exact link (LA would know! LOL) but in Calif there was a case against 2 gay men who were doing consensual BDSM in their own home and a neighborhood peeping tom called the police and they were arrested (both) under the same charges. 

I'm sorry that police stupidity offends you so much, it offends both myself and my brother as well - but you should direct your insults at those actually committing the offense, not at the officers trying to protect those of us in the lifestyle by offering advice.

If someone is a jailer, and not a road deputy, then they aren't a 'cop', so we can dispense with that as a reliable source of legal expertise right away. Ditto for TV shows, rumors, and gossip.

Next, we can address the fact that the the US Supreme Court made sodomy legal in every bedroom in the land, and toss  that  out the window as well.  Arresting someone for a perfectly legal activity doesn't make that activity illegal, it makes the person doing the arresting wrong. 

And finally, going back to the issue of consent making someone an accessory to their own criminal vicitmization, I'm still waiting to hear about all of the consenting women being charged as accessories to their own rape. (In the US, not Iran).

Its perfectly obvious to me that you want to sling insults and not converse on the actual wrongness of police and law enforcement targeting one group of people, such as those of us in the lifestyle.  I would have loved to have said more on this topic but I am unwilling to get involved in a mud slinging debate about whether or not my brother is a "real" cop, which is not the topic at hand. 

I apologize to the OP if this took their post off topic. 

OP:  I agree that it scares me that any state in the country can arrest someone on sexual crime laws because their fence is too high.  And if there are too many people in one house?  Um, there goes any BDSM/poly families.  We're going further and further into a "Big Brother society" and it doesn't bode well for those of us in the lifestyle.  But I do believe that there is a distinction between the illegal slave trade of young girls and boys and the consensual practices of BDSM and I hope that there are some in the law enforcement and court systems that will be able to tell the difference.

If it is that obvious, why didn't you respond to my posts when I was making that very point, instead off trying to pass off gossip as legal expertise?

Or you could continue with the name calling and evasion, instead of addressing the Supreme Court ruling that explicity refutes the scare mongering you are trying to peddle here.

I am not saying that this particular news brief was about the same thing.  Only that We in the lifestyle cannot be blind to the predjudices of others. Nor can we try to group all "law enforcement" in the "they're out to get us" catagory.  Only be sure to play with caution, be careful who you confide in, and if the law gets involved and you get arrested - KEEP your MOUTH shut until you have a lawyer.  And that my friends comes directly from my cop brother!

Isn't it frightening how much of the U.S. population is unaware or so short sighted that the real implications and threats to our freedom go unnoticed or are accepted in general practice in the name of "safety"? 

Lady Scarlett - I know for a fact it is true that corrections/sheriffs officers can be charged and prosecuted for sexual assult if that officer had consentual sex with someone under custody - such as a prisoner. A prisoner is considered , like a child - to be unable to give consent in that situation. The power differential. ( I studied law and worked for the NJ court system - why, oh why? - but now long away)  

Scary stuff...

Alumbrado  you evidently no nothing about corrections or law enforcement.... i went to school and learned the same things as a law enforcement officer... but .. now i am also a corrections officer and a law enforcement officer and have made arrest and work in a jail... there are a lot of us in the lifestyle but there are as many who dont understand it.... sometimes its not the cop that has the problem.. what about the "Dominant" who has the problem like the one over here on the West coast of Fla who was pimping his slave out.... for cash .. he we to jail... and she pressed rape charges... with all right to do so.....

Fairly well ANYTHING can be justified by wraping it up inside the word 'BDSM'. Remind me sometime to tell you about the guy who was huffing glue and justifing it with "how dare you judge my kink".

I may not 'no anything', but I do 'know' a lot about LE... from having worked it, studied it, and taught it for decades (including in Fla.)
And neither you, or anyone else can cite a current legitimate charge of 'accessory to their own rape' levelled against a woman having consensual sex in the US.

Damn. Prices must have dropped rather drastically. I'd expect to pay at least USD 150. Some apparently charge as much as USD 1.500, although I expect that's when there are special requirements involved (e.g. North Americans cost way more than Chinese or East Europeans) or somesuch.

Sounds like they are after sex slave brothels, more than privately owned slaves. Which makes sense, as the latter implies a wealthy household. Kind of like how they arrest anyone suspected of smoking crack, but leave Hollywood alone for the most part. Going after wealthy people has never been a popular pastime for law enforcement.

Very common trend. Although those are of a different sort. Which may explain the lower prices. The difference between being sold as a slave (and basically told you are one), and being told you owe them lots of money and have to "work off your debt" before you can be free, etc...

A bit over the top, but no doubt the police could crack down on some M/s relationships whenever they need a bit of good publicity to cover up the latest case of police brutality, or need some popular support in an election year, or whatever. Mostly, though, I doubt that's a very hard problem to avoid, if they are going by so general markers.

While I certainly agree with the rest you said, I'd say this is the more common scenario.

And, having four cops in my close family (two aunts, two uncles, one of them my godfather), I'd say that at least two of them would most likely make just such a comment. I'm not sure about the "jokingly" part, though. In any case, they're pretty much used to seeing this kind of thing. And not just when someone has lost the keys to their cuffs.

Point being, though, that the police can harrass you legally. And the difference isn't as big as one would like to think, since there's a strong tendency for people to trust the police to the point of assuming that they had a good reason for hauling you off, even if they didn't. It tarnishes your reputation in the court of public opinion, often permanently.

boy if they're going by high fences and trashy yards the texas cops in some places are going to be really really busy. Maybe they'll finally get to that old trailer park that's been an eyesore forever and a day LOL. What about dogs? Sure slavers must have vicious dogs in case the property makes a run for the border.
