In my experience doctors are more wrong than right. You have to take a proactive approach to your own health these days. Just because a doctor throws a diagnosis at you, you need to do your own research because people are misdiagnosed all the time. It is very common.

And with a diagnosis like that, they should have sent a sample to more than one lab. The error would have been found quite quickly had they done that. She may have got a second opinion but did they take a 2nd sample? The problem is that the lab mislabeled the sample. So the lab could retest it 100 times and still come back as the same result.

Actually, this is only half true.  The main specimen is labelled by the nurse assisting the doctor who takes the specimen, also called a biopsy.  It's labelled at the bedside or in the operating room and then is sent to the lab.  It's after it arrives at the lab and goes through a complicated procedure to prepare it for review by the pathologist that the mis-labelling would have happened.  Many times in a pathology lab, specimens are assigned numbers chronologically, rather than names, THAT is where the mislabelling probably happened. 

If they had asked for a re-test to confirm that diagnosis, the lab would have gone back to the original specimen, which was labelled by the attending nurse and it would have been tested alone and given another number, and the correct results would most likely have been obtained and the mistake discovered.  That's the biggest reason re-testing is done when receiving a diagnosis of "highly invasive cancer" is to verify that diagnosis by running the test again, and I'm really surprised a second biopsy wasn't done, I would certainly insist on one. 

Not that that excuses it, it's a horrible mistake.

I read about somebody who went in to have a gangrenous leg removed (diabetes) and wrote with a black marks-a-lot allow over the other one that it was NOT the leg to cut off, and on the other one "CORRECT LEG TO REMOVE."

Proactive, yeah.

I had a doctor tell me a certain medicine he had me on could not be causing the side effects.  I got so tired of hearing his twaddle that I finally looked at him and said "Get your perscription pad, write what you just told me, and sign it, and I will believe you."  His decision was to switch the medication.

My mother had to have surgury on her wrist a few years ago. And during the prep each doctor and nurse marked with a marker and checked over and over again to make sure they were going to do it on the correct arm. Some doctors are starting to do this. Long before the operation...they will physically mark the area and have several people double-check it.

You would think that they couldnt possibly make such a stupid mistake but operating on the wrong arm or the wrong leg or removing the wrong kidney....it happens all the time.

The problem with the medical malpractice suits is that a lot of the time they aren't justified. At all. Obviously it would be here but...

Will never forget the day when a former patient of my father's lost his suit. Threw down his crutches and stormed out of the courtroom. God that was funny. Shame about all the fuckers who sue when they shouldn't. That is why your medical bills are so high folks! Works the same way your car insurence does. Malpractice insurence companies pay out a few mill, charge the all doctors they cover to make up for it, doctors charge you to make up for what they have to pay just to be able to practice.

It's ok. I honestly don't know which is better though - knowing that surgery isn't safe and that I am taking a risk, or living in a happy delusion where there are no fuck-ups and obviously surgeons and nurses and everyone are horrible people when things go wrong. [:'(]

Actually, the problem with having or not having them is the same.

They are put in place so that when somebody screws up, the person who got screwed is cared for.

What has happened is that insurance companies want to collect revenues without paying claims, so they are trying to screw the individual they are supposed to be helping.  This known as bad faith.

Individuals have filed lawsuits to try to screw the system, in essence attempting to screw the company who should be using good faith to protect the individual.  This is known as fraud, etc.

The problem is not inherently malpractice suits, the problem is duplicity and bad faith and fraud and an attempt by entity A to screw entity B and not play by the rules.

The only thing limiting them or preventing them does is give an unfair advantage to the companies; hence the huge campaign financing for changing them.  This is similar to deregulation laws; they are sold as a panacea for government bloating and high prices, and prices soon after skyrocket and service quality pummets.

This has been common practise for awhile, and is one of the reasons the "oops, wrong side!" cases are way way down from the '80s or so.

I got a smily face on my thumb, and initials on a knee.  The neck/skull didn't get any....but maybe they should have - what if they'd cut on my bum instead!

There are a few hospitals in Boston that currently have a policy that the surgeon has to " autograph " the area he is doing surgery on. It's done in Pre Op before the patient is given medicine and the surgeon has to verbally say... " left pinky finger, correct ? " or similar wording.
I'm sure there are many other hospitals elswewhere that have this policy and I suspect it will become the accepted standard in the near future.
