SCRANTON, Pa. -- Talk about a potty mouth.


A Scranton woman who allegedly shouted profanities at her overflowing toilet within earshot of a neighbor was cited for disorderly conduct, authorities said.


Dawn Herb could face up to 90 days in jail and a fine of up to $300.

"It doesn't make any sense. I was in my house. It's not like I was outside or drunk," Herb told The Times-Tribune of Scranton. "The toilet was overflowing and leaking down into the kitchen and I was yelling (for my daughter) to get the mop."


Herb doesn't recall exactly what she said, but she admitted letting more than a few choice words fly near an open bathroom window Thursday night.


Her next-door neighbor, a city police officer who was off-duty at the time, asked her to keep it down, police said. When she continued, the officer called police.


Mary Catherine Roper, an attorney with the American Civil Liberties Union in Philadelphia, took issue with the citation.


"You can't prosecute somebody for swearing at a cop or a toilet," she said.

I love the term 'potty mouth'. My ex used to call me it - not sure why
 
On a serious note though i nearly got arrested for swearing kind of half under my breath in the presence of a police man. I had finished work and gone to a club with a friend, I was only drinking water i shall add. I was crossing the road behind a parked van, bad road sense i know lol. Anyway a car came and nearly hit me and i muttered 'oh fuck' resulting in the police officer threatening to arrest me for use of foul language and drunk and disorderly.

There was a similar case in the UK not long ago. A 16 year old was on the phone to his friend and said something like “You’re fucking kidding me…” Walking behind him was a police officer that overheard his private conversation. So he got given an on the spot fine. Swear words are no different to other words and if there wasn’t a use for them then they shouldn’t exist. Having said that, people that say the fucking F word in every other fucking sentence annoy the fucking hell out if me.

I mean really, I think some people just like to be offended by the actions of others. I was reversing my car the other day and some woman in her child meat wagon came down the road along side me. She stopped next to me to indicate that she was there and that I hadn’t seen her because I was looking behind whilst reversing, the prat. She was a good clear metre away from me and there was more chance of a dildoe factory opening on the moon than me hitting her (with my car that is).

getting fined or arrested for cursing, is nearly as stupid as suing mcdonalds for being fat. people these days need to get a grip on reality.

Had a British friend almost get himself arrested in Poland some years back.

He only shouted out 'Hoi!' to a friend across the street.

Two Polish policemen standing near his friend moved in to arrest him.

They thought that this friend was insulting them. 'Chuj' (pronounced 'hoi') means 'prick', It's the strongest most offensive of all Polish swearwords.

Fortunately when he spoke in English (he couldn't speak Polish) the policemen laughed and let him go.

I read that article on CNN yesterday and thought of bringing it up but got too busy.

I believe the cussing is no worse or better than any other noise pollution from a neighbor (loud stereos, dogs barking nonstop etc). 

Arrest? hmm that is a little extreme. Disorderly conduct as far as I know cannot be enforced in one's own home. 

A fine or noise bylaw warning should be suitable enough.
