Judge allows class action against Target Web site Wed Oct 3, 8:12 AM ET



NEW YORK (Reuters) - A federal judge in California certified a class action lawsuit against Target Corp brought by plaintiffs claiming the discount retailer's Web site is inaccessible to the blind, according to court documents.



Judge Marilyn Patel of the U.S. District Court for the Northern District of California also rejected Target's motion for summary judgment in the case, according to the ruling filed October 2.

According to the ruling, plaintiffs -- including the National Federation of the Blind -- claim Target.com violates federal and state laws prohibiting discrimination against the disabled.

"This is a tremendous step forward for blind people throughout the country who for too long have been denied equal access to the Internet economy," Marc Maurer, president of the National Federation for the Blind, said in a statement.

"All e-commerce businesses should take note of this decision and immediately take steps to open their doors to the blind," Maurer said.

"Target is committed to serving all of our guests and we believe that our Web site is fully accessible and complies with all applicable laws," Bloomberg quoted Target spokeswoman Carolyn Brookter as saying in an e-mailed statement.

Target was not immediately available for comment to Reuters.

I've long felt that news videos should be closed-captioned. I can understand wanting websites in general available without having to use expensive programs. Some can only afford public computers and are stuck going to read-only or audio-only which are rarely together.

So why would this put gravel in your granola?

Im just surprised the court even let this go to trial, actually. I hate pointless lawsuits like this. All it does is tie up the justice system, while real crimes are put on hold.

The article linked is too vague and doesn't mention that the lawsuit is over the Target website's lack of coding for blind-accessible text-to-speech programs (which many other large retailer websites have).

That's not to say it isn't debatable, but the argument isn't necessarily as far-fetched and ridiculous as it may seem at first glance. 

Also, 'pointless' lawsuits are good for setting precedent and in that sense the point is in creating grounds for further, similiar lawsuits to be summarily dismissed.

So only 'real crimes' should be a focus of the legal system?

In most design programs it is set to default so you also develop the site for the blind.
Target not having it done is sheer oversight on their part.

Maybe other sites will come into compliance this way.

Not pointless.

Without suits,things don`t change.

C`mon folks.Of course blind people use computers!

The  specialized programs help them immensely,with brail and audio stuff,etc.

They want ,what everyone wants,access to good buys,mail-ordering,etc.

instead of some useless lawsuits, yes. like the one a few years ago, where those people were suing mcdonalds for the fact that they were overwheight. Now, if mcdonalds had force fed them theyre product, it would be something to be angry about.

Those were the laws suits that got trans-fat removed from food.

Lol, Are you complaining about that?Would you rather have that stuff back in your food,or your kids`s food?

And now trans fats are being removed from fast foods and many other processed foods.

honestly, we're way too health concerned in this society. Granted, we should take care of ourseves, but things have gone overboard. Heres the thing: one day, may not be today, might not be for awhile, but one day, your going to get old, your going to get fat, your looks will fade, along with your brain cells, and we will all eventually die. Period.

I'd prefer that people, including chefs, had the option of preparing and offering foods created with trans-fats.

Actually, to go further, I'd prefer that people had enough sense to make rational decisions about what they eat instead of pouring grease down their throats and crying about how they've become morbidly obese because they can't read so that the government wouldn't feel it necessary to step-in in the first place. It isn't as if someone who eats fast-food every day is going to benefit much from the lack of trans-fat anyhow. They're still going to get clogged arteries because lack of trans-fat doesn't make something healthy, whereas people who indulge on occasion didn't have anything to worry about to begin with.
