Status: offline 		You could enforce vagrancy laws, and require that people who want to live off the land go out into the woods to do so, not let them hang around in cities, as most of mankind has done ever since cities were created.  And get the one who are insane into asylums to protect them  and society from themselves.

(There's a LOT more things we shouldn't have done though!)

Had that woman been tied to my bed she'd never have been sleep or any other kind of "walking!"
And I'd have been up to my balls in her!

Status: offline 		Why would a girl with this kind of problem not  have protected herself from sleepwalking when she went to college?  More then likely it wasn't her first event, why didn't she take precautions? - what a truly sad story.

Status: offline 		Even thought in this story the perpetrator was homeless. It could very well have been a man with a house and job. Or even a trusted friend, spouse or family member. So what would the answer be then? That is was done by a homeless man is not so noticable to as the fact that it was done!

**And velvetears raises a good point; WAS that her first time sleep walking?

Whether she's done it before or not shouldn't mean much when it comes time to prosecute.

Someone hitting her with a car would be on trial. Someone stabbing her through the face with an icepick would be on trial. Someone letting his dog maul her to death would be on trial. Someone pushing her off a bridge would be on trial.

And someone who knows that he's HIV positive and has sex with anyone without telling them would be on trial.

Given the fact that sleepwalkers do not typically have lucid conversations it ought to have been obvious to anyone that she was in no condition to give consent.

Status: offline 		I contest none of what you say and totally agree. A crime is a crime no matter how it occurred or who was involved. I was just wondering what steps had been taken to help prevent her from sleep wlaking so that she wouldn't have to worry about sleep walking and getting hit by a car or anything else.

Somnambulist is the proper name for people with that condition, and quite a bit has been reported about their activities. Somnablulism is the term for the condition.

This is from very old text, don't even ask, but I have heard and read many things. Somnambuolists have done some amazing things, for one conquer their fears, like climbing a tree when in normal life they are extremely acrophobic. Another thing is driving a car, much more common, but face it, you simply can't do that with your eyes closed.

In fact recently I heard of it being a side effect of a new drug they were advertising. Also increased gambling urges.

How long are you going to wonder why I refuse it all. I don't even take aspirin. I want none of it. Perioid.

Yes, perioid.

The guy might actually be innocent, the girl might have offered it up, but then woke up in the middle of it. If that happened this guy is getting screwed bad. There is no card you can give to someone that says "I do not have somnambulism". . or "I hereby certify that I am really awake".

Hey that is a possibility, what if it is true ? I'd be the first one to advocate the execution of rapists, but here we have some doubt.

What to do ?

Status: offline 		No worries. I get that. I understand that you weren't trying to say that it's her fault. I was just elaborating for effect primarily.

Precautions are all well and good. But for some who sleepwalk they don't make a lick of difference. You can tie yourself to the bed or sleep in a sleeping bag to make it more difficult to get up. You can shut and lock doors. But some sleepwalkers, especially those who have a pretty good mental map of their home and surroundings can bypass these failsafes.

As a child I walked in my sleep. I'd walk halfway down the stairs most of the time... and curl up on the landing to go back to sleep. However, one night I walked all the way downstairs... unlocked the front door and stepped outside to sleep on the porch. My father nearly tripped over me the next morning. Imagine his surprise. 

I only made it outside twice. In fact, I only made it downstairs twice. But that's what can and sometimes does happen. I grew out of it, as most children tend to.

But there are an unlucky few, perhaps because of stress or some sort of whacked brain chemistry, that continue to do so.

A decent person should have known something was very wrong and tried to help, called the police or whatever.
If she was walking on the side of the road like that you would have to take immediate action to make sure she was safe and not exposed to anymore danger at that point!
She very well could have been hit by a car.
This bum needs to die!
