The TOS and the "guidelines" aka the "rules" do not govern anything here the law does.   Yet when you are a moderator here on CollarChat you seem to be able to do what you want to do. This includes allowing friends and associates to attack other people then banning other people for just debating.   If you will note who is allowed to repeatedly attack others you will also probably find them as moderators or friends of moderators here.   You also cannot legally censor speech with broad rules that are all inclusive-you must be specific and have an overwhelming legal reason.   Nor can they legally play favorites; which does occurs.   Though, they do not want you to know more than they do about this so that they can censor or ban anyone for any reason.

Unless you believe that CM is in fact run and owned by the government of the United States or receives funding from the government to run a d/s bdsm board (which would be quite humorous), they can in fact refuse service to whomever they chose legally.

It's easy to say well officer everyone else was speeding and you didn't ticket them, it is not, however, ever a valid defense for your own actions.

Please cite the laws pertinent to your position... I would be flabbergasted if you actually do.

Oh, and one more thing, if you think that making a new screen name makes one incognito so that they can flame with impunity, think again... they can track your ISP and compare it to others in their records.

hmmm... maybe we have a 'waiting approval' control freak as a mod right now?

“Please cite the laws pertinent to your position... I would be flabbergasted if you actually do.”   It is amusing how scared the mods are of the truth. As you can see them mods will delete anything contrary to what they want the truth to be.

“Oh, and one more thing, if you think that making a new screen name makes one incognito so that they can flame with impunity, think again... they can track your ISP and compare it to others in their records.”   As I said, the mods do not wish people to know. States also confer free speech rights too, and most TOS’s are really unenforceable because acceptance problems, and consideration…..etc. Do your homework. The mods do not want people to know their rights hence those rights being enforced on them. Also posting anonymously is a privacy right.   We are not being allowed to have a free discussion.

I'm sure this is going to get pulled but your version of the law seems to be incredibly self-serving and not even remotely close to true.  There's no right to post anonymously when it comes to admin.  Read the contract.  There's no right to say whatever you want ever, even when it applies to the government, which here it does not.  The consideration you get from the TOS is the ability to post here and free despite the fact that there is a monetary value in the industry for the service.  There are plenty of cases on internet contracts that are very similar that have found them to be quite valid.  Again, it's not a conspiracy, get over it but stop misstating the law to be something you want it to be.  That's not it.

I have been finger-waged once or twice and, as far as I am concerned, it could happen dozens more times and that is a-ok with me. Having said that, as strong as I am, when I saw this moring that Mod 11 looked at my profile (note that I didn't use the phrase 'perved my profile'- Mods are WAY more classy than that) and I swear it was like I was called to the principal's office.   Something that never happened to me when I was in school!  I literally was like 'oh no! *searches memory bank for possible offence* what did I do!?'. In the end, she just looked- nothing more. And I have to say "Kudos!" now THAT is real power when just the sight of your bold red name makes someone pause...

And I would HAVE to agree, looking at Mod 11s profile, which is so empty yet so umm Dommly, and watching how she is posting here, I find myself very attracted to Her, is it like a school girl, principal thing?  Or just, ah, its something, I think I will be thinking of HER through out my holidays, (oh mod 11, I am not THAT far away ;)

There's no right to say whatever you want ever

A poster has the right to say whatever he/she desires, and the Mods will impose their laws accordingly. The poster has the right to appeal against said laws, and the Mods will enforce them where they see fit.

'Not a problem, house rules etc.

My view is this: it's a great service free of charge, this life ain't remotely concerned with something for nothing, but this place stands the norm on its head.

The poster I responded to is saying "the law" as it applies to contract law and the right of free speech in the United States and claiming it is their right legally.  He/she is not referring to CM "law" that I can tell and in fact that on the issue of free speech where there is no government action, they can in fact suppress your statements or refuse to allow you to speak, even in the arena of govenmental action and free speech you cannot speak unlimited.  That was my point, not CM's "law" as that is merely a matter of contract and stated rules enforcing that contract.

However, your point does have merit NG as the rights one has on this site come from that contract http://www.collarme.com/tos.asp and for the most part not the First Amendment for American posters at least (maybe even all as I seem to recall the TOS sets jurisdiction for disputes as being in the US).

I disagree. You agree to live by house rules, and house rules dictate that you can say whatever you want, but unacceptable posts will be dealt with accordingly.

What opened my eyes in the Terms of Service was how many times the $50,000 was used...I wonder if there has ever been a judgment for money because of a paragraph or two in a TOS?

That is to cover third party damages, if you are responsible for someone making claims against the site, it just says the site can claim those damages from you. Another reason that when people click the yes button to say you have read the agreement they should actually read it. The people that don’t know what is at stake are the irresponsible ones that haven’t and so think the rules are only there to ruin peoples fun. The site isn’t going to be out of pocket if someone makes a ridiculous claim against it, you are.

OK I have to say this.  Anyone else see the irony that domiguy is on "Awaiting Approval" in the Awaiting Approval thread?

(of course as soon as his post is posted, this post won't make any sense, heh)
