No lets look at why since 2001 there have been thirty reversals from death row.

Let us not bog down in a conversation that is chosen to have no bearing on its decision, no change, no illumination........

Rather, go to first causes if we must find fault and slaughter dogs, why did Clements and his corrupt republican conservative administration and courts allow such a miscarraige of justice, and why has overwhelmingly republican texas gottten truth and justice so wrong so that it is destroying the whole of america now?

And don't lie and pretend that I am a left-winger....no such thing even exists in the same galaxy as that lie.

Charactarize your own ass, and leave mine out of it.

It's Texas...what do you expect? This is the state that thinks the more people they lock up and the more people they execute the lower the crime rate.

Right?

Why do you insist in lumping all of us on the right with Bush, Owner?  I never supported the Patriot Act, and my position is the position of many conservatives.  The neo-cons have taken to calling people like me paleo-conservatives and they dislike us more than they dislike those of you on the left.  We are the ones that routinely pull votes away from them in Republican primaries, and we have been fighting tooth and nail to take back our party from the Christian fundies, the Wilsonism globalists, and the war hawks.  If you really believe that the Patriot Act is as wrong as I do, then you may want to take a look at the positions of the mainstream Democratic candidates.  The Lady Hillary is not going to change anything if she is elected President.

Life for rape??? but murderers get even as low as 1-5 years and some never see a day in prison??? makes no sense!!!!!

Apparently you have never been raped.

Rape leaves a liiving victim who is oftentimes a shell of who they once were. They usually relive the trauma over and over, and it has a lasting effect on all of their personal relationships.

Some might say that it is worse than murder. You might have a look at the suicide rates of rape victims, many of whom prefer death to living with what they have been through.

Yes, I agree it is ridiculous some of the sentences that people get for murder. But at least the murder victim does not have to face what happened to them over and over.

ummm the family members of the murder victim have to face it daily and there is no therapy that gives the victim the chance to recover from being murdered.  the corpse is not the only victim of a murder by far.

not to lessen the pain of rape-but this is apples to oranges comparison, and frankly offended the heck out of me........the murdered person has no chance to get counseling and get over it, no chance to wake up and see a sunrise and think no matter what happened i am a survivor and i am alive!

see my entire family is a victim of murder, but we are the ones that  survived it and deal with it regularly.

LAM according to the article he did not ask for the test to be done untill 2004.  Why exactly did Gov Richards keep him in jail?  Since you want to take it to that level.  People don't really pretend Republicans are scouring the jails looking for the innoccent to set free.  Democrats do pretend they care about these people.  So I was pointing out that this defies the popular sterotype.

That's probably how long it took for the Innocence Project to take on this case.  They have overturned some big cases based on technology and new defenses, I'm sure they are flooded with requests.

I do agree that a life sentence is long for a rape and yes as I've stated here many times before I am a previous rape victim so sympathy ploys aren't really all that applicable to the fact that our prisons are overcrowded and it's very unusual to see a sentence that long for this type of crime.  I wonder what other things this guy had in his presentencing investigation.  The length of the sentence leads me to believe this is not isolated.

Keep also in mind the other side of this error....the actual rapist was never caught.

at least they have a dna profile now.....it would be great if it caught a match on the database they use.

What grounds would Richards have had for releasing him?

It is great news that this man wrongfully convicted (Nothing about it in the fox article, but anyone want to bet that the accused was black and victim white), while the Democrats ran the place, is finally being set free.

Emphasis added.

You disappoint me, Lucky. Even when we've disagreed, I've generally respected your posts, which makes me all the more sorry that you've taken an appalling judicial tragedy as a opportunity for cheap (and, as far as I can tell, irrelevant) partisan bickering.

luckydog1 -> RE: Wrongully convicted man cleared of rape after 26 years in prison (1/4/2008 7:12:12 PM)

DC so tragedy is off limits for Partisan bickering, thats a new one.

There are other posters, on both sides of the aisle, who do indeed seem to regard any subject as fair game for partisanship, but I'd honestly expected better of you.

Oh well. Live and learn.

Who knows?  I hope you do agree that whatever he had in his pre-sentencing history is irrelevant if he was wrongfully convicted.

Oh of course, I was merely commenting on the remarks on the length of sentence LaM.

Bullshit.  They should have just executed the fucker when they had the chance, and then they never would have had to deal with this crap.  Exculpatory DNA evidence my ass.

No system is 100% efficient, so a miscarriage of justice is nothing out of the ordinary. Liberal Ron is well versed in this philosophy; in the event you need a second opinion, he's partial to offering a whole host of liberal views and methods.

LadyEllen -> RE: Wrongully convicted man cleared of rape after 26 years in prison (1/5/2008 6:27:37 AM)

Compensation
Well, I think the real issue is not compensation, but how much this guy cost the taxpayer for his bed and board for 26 years

If it were averaged out to around $10,000-00 per annum, he owes $260,000-00 - far more once we add compound interest year on year.

No - I dont really believe that, but this is what our government did to a group of guys convicted and sent to prison for years on end, on the strength of evidence acquired by less than satisfactory police methods (torture, in fact). They were awarded compensation - and then the government had the audacity to take them back to court to claim bed and board from them.

DNA Databases
There are a lot of good arguments for this - but there is one overwhelming argument against, and that is that it would be managed by people, who are fallible in the extreme in the handling of such information, and subject to all manner of influences which might lead to the information being misused.

In any case, I've heard that in the UK at least, something like 90% of all offences are committed by the same 10% of the population - and if we're taking DNA samples from those 10% anyway, then we have a 90% detection rate from the off, without much police work being necessary above the taking of scene of crime evidence and lab work. This relieves the police to work on just 10% of crime - or of course to sit in laybys with speed cameras, which is generally far more lucrative.

Or, we could reduce spending on police and use the money to build enough prisons to cope with the 90% detection rate, so we dont have the stupid situation of dangerous people being put in open prisons or given community service because there arent enough places.

Has there been an increase in arson in Britain of late? A good way to destroy all the DNA evidence is to burn the crime scene... it seems like that would be common knowledge, and it also seems like a lot of things would be going up in flames these days on the account of desperate criminals who don't want to get caught

Ok then, some questions.

Which party has been trying(unsuccessfully)to change the Patriot Act,and which one has blocked those efforts?

Anytime the dems attempted to put our nation back under  the US Constitution, the republicans, both neo and paleo, scuttled those efforts.

Why is that?

In fact,'07' was a record setting year for conservative Senate filibusters(a rule that allows just one single guy,the right to stop any bill) at 62.(with one filibuster by Chris Dodd (d-Conn))

That was the rank and file republican party, the whole lot of ya,marching in lock-set with Bush
.

And, America is to believe the new republican talking points, that last year`s congress, was a "do nothing congress"?LOL   After it was the GOP that blocked everything, including any action on Iraq, other than clubbing the democrats into giving Bush more money.

Senate republicans successfully blocked the democrat`s agenda.Successful though,in the way Ted Bundy was successful, not the good kind of success.

http://www.npr.org/templates/story/story.php?storyId=17441671

Lawmakers in Congress end the year with a few major accomplishments such as the energy bill, some failures such as the immigration overhaul, and a number of compromises and frustrations. Democrats, who took the reins of both the House and Senate in January, acknowledge feeling deeply frustrated by a Republican Senate minority that set a new record for filibusters this year, blocking much of the Democratic agenda.

http://www.mcclatchydc.com/homepage/story/18218.html

A good article, left leaning ,but fair.

http://home.ourfuture.org/assets/block-and-blame.pdf

One last question.

Can you list the any and all elected republican representatives and senators, who are apposed the Patriot Act(and voted that way)?Or any that acted against the bill?
