ok- if a house slides down the hill onto your house- who sues who? when red tagged any well where does one go?

Typically a house doesn't slide down a hill absent some screwup on the person that either approved the lot or built the house unless there has been some natural disaster that caused unforseen damage/weakening.   I've been involved in a few of these cases.  The people that get sued are EVERYONE from the person that sold the lot to the agency that approved the lot on up to the final builder.  It then becomes a battle of experts to determine who exactly is to blame.  None of these things really help the now homeless families to any quick resolution though pa and given your lack of love for attorneys stated on many prior occasions, you do realize there's no good way to proceed on your own on something this complicated don't you?

I dunno, who is the bigger idiot? The one that built the house on top of the hill that might slide down or the person that built the house at the bottom of the hill below the house that might slide down on top of it?

Neither should sue, both were idiots.

think Southern CA.. mudslides/houses built stupidly (REPEATEDLY).  I think BOTH oughta be sued.. if you're stupid enough to bulid somewhere that is a known mudslide area, then go to hell ...LOL

Personally, I think this whole sueing busniess has just gotten compleatly out of control. Whatever happened to taking responsibilty for your own actions?  You built a house on a hill in california. there are mudslides there. the house above yours is probably going to slide before yours does.

Its like here in florida...about 10 or 15 years ago I remember the swamps drying out almost compleatly. Places that I can remember being 3 feet of standing water were now compleatly dry ground. TONS of realestate got sold. people came in with bulldozers to clear the land. Everysingle day I was confounded by the stupidity of people. Look folks. If you have to remove a cypress tree to build your house......you are probably going to have some flooding issues later on. Several years later. Water tables came back up. Fucking idiot home owners started sueing everyone in sight. Fuckers. why didnt you do your own blasted research?

first i would hope there's nobody in the house thats being hit!!!
2ndly they both should have insurance to cover it because i know this has actually happened before.

I don't know who sues who.  I think if an insurance company is stupid enough to insure when they know there are going to be issues.  They should pay.
There are a lot of houses built on hills in So Cal.  At least every other year the hill goes up in flames.  It is the homeowners responsibility to keep the brush cleared...if they don't.  They should be at fault.
If they don't keep the brush cleared it is going to endanger firefighters lives when they have to try to feebly save the house.
In turn...IF they do save it.  The following year when the rains come the house is going to slide down the hill.  No vegetation to stop anything.
Its a vicious cycle and its not going to stop.

You are all assuming that you could know.  The simple fact in the cases I have been involved in is you could not as an average consumer without scientific knowledge.  When someone inspects a lot and approves it they guarantee that under the weather/natural conditions existing for that area at that time this lot is safe for the house to stay in place.  There is no reason why the average home buyer would question such a guarantee nor would most have the scientific knowledge to make any assumptions other than what they have been told by the experts that should know.

If the average homeowner in California doesn't know they haven't been watching the news.  Most people do know living on a hill is unsafe.  Yet, they still do it because the view is so beautiful...etc.
They actually usually interview the homeowners on the local news as their house starts to slide or has slid.
They usually know the dangers.
They just hope it will never happen to them.
