Burglars and thieves who steal to fund an addiction to drugs, gambling or drink could escape jail even if they target a vulnerable victim such as an elderly shopkeeper, under new official guidelines.

Oh geez.. arent all criminals Desperate and in need. If they werent they wouldnt bloody do it now would they?

I wonder what % of them are not poor, on drugs or booze?

*chuckles* I still get a kick out of the poor little granny that got in trouble for *defending* herself with her knitting needles when she was mugged. The whole "she had a weapon!" Bloody hell folks if someone is mugging me I will use my keys, my shoe, the nearest small person.. a frozen herring if nessasary to beat them over the fucking head with.  

now if the person lifts a loaf of bread I dont think they should go to jail.. I think they should get some help and a slap on the wrist. "Please dont do that again.. please come to us before you take those measures" kinda thing.


Comon sense isnt so common is it?

We recently discussed prison reform for pages and pages here.

I broadly characterised offenders as being "mad", "sad" or "bad" in that discussion, with a view to proposing different treatments aimed at doing what can be done to maintain public safety.

In such a scheme, the "bad" - those who are professional criminals, dangerous and violent offenders who will remain a public threat for a long time regardless of how many days have elapsed within prison, get longer, even indefinite sentences, to maintain public safety.

The "mad" in my scheme - UK prisons are filled with psychiatric cases who because of their conditions come into conflict with the law at some stage, and there is nowhere else for them to be sent, would go to new psychiatric hospitals where they can be treated far more appropriately than in a prison.

But the bulk of crime as I saw it, was committed by the "sad"; those whose life circumstances are so hopeless that crime is their only viable path to survive, and/or to feed the drug habit they have developed to escape their circumstances.The only real solutions here are to provide a better socio-economic model which reduces the number of "sad" people by providing viable alternatives to crime. There must still be punishment but unless time in custody is used to improve their circumstances - including drug treatment, and there is a viable alternative life available for them outside the prison, they will simply return within months.

What if we reopened the psychiatric hospitals, and had a secure wing to each and a drugs rehab wing to each?

I see a loophole here.. what if someone was a smoker? Or what if you were addicted to say chocolate, or sex? Would this mean a rapist, for example, gets a lighter sentence if he can prove he's addicted to sex?

What about binge eaters? Are they not addicted to food? Does this mean that it's okay for someone to break into your house and clean out your fridge because they were desperate for food and they didn't have any money?

I was sexually assaulted by a convicted paedophile in 2006 along with a few other women, one of whom gave him HIV. He spent 7 months on remand, pleaded guilty to absconding from the Sex Offender's Register and to this assault on the woman who gave him HIV. The prosecution entered into a plea bargain with him. He pleaded not guilty to the assault on me and the other woman. The prosecution withdrew the charges relating to me and other woman. The judge sentenced him to 12 months' imprisonment and he walked free from court because of remission and parole. The charges withdrawn are held 'on record' to be answered if he reoffends.

IF HE REOFFENDS!!?? WTF!!!?? We're talking of a convicted paedophile who now has HIV. One more victim is necessary to prove beyond reasonable doubt that he's a danger to society.

Now I wouldn't mind if this was the idea of a retarded 15 year old who's been sheltered from life, but it's come from a politician.  

This isn't just about prison reform.. Take a look around you. We are dealing with an Establishment which is by and large irresponsible, an Establishment which fully expects you to be responsible but which as we can see here doesn't feel any sense of responsibility towards you.

This is the Government which was elected to power for being 'tough on crime, tough on the causes of crime' in 1997. It's now 2008. Back in the 1980's we had 'back to basics', back in 1981 it was the 'short, sharp shock'.

Is there actually any point in voting for someone who by and large perceives you as an idiot?

A rapist is a violent, dangerous offender - indefinite sentence to protect public safety
If he is addicted to sex (ie has a proven psychosexual pathology) then he gets treatment; Androcur twice/day, in the secure wing of the psychiatric hospital - this is not a "soft" option, but a more appropriate option, which fulfils all the aims of prison

Other addicts or similarly psychopathologically affected offenders get similar treatment

Prison is not the place for treating psychiatric conditions, if we are interested in results rather than process.

Though I despair that our police force is stretched so thin and so tied up with paperwork as to be largely ineffective, it does mean that if anyone has the misfortune of randomly breaking into my house then it'll be years before they get around to investigating my ever increasing patio......
