I've been hearing All Summer Long by Kidd Rock on the radio a lot lately.  Am I the only one that thinks the melody sounds a helluva lot like the melody to Werewolves of London by Warren Zevon?

        Sounds like a complete rip-off to me.  Maybe Warren won't need to do as many Halloween shows after the lawsuit?

Kid Rock is the new Vanilla Ice, he hasn't written an original score to any of his songs, he just sample's others.

       That obviously went under my radar...

      My girlfriend won tickets to one of those 10/31 shows, back in the early 90's.  Nowhere near angry enough for my tastes.

It's not a rip off, he legally sampled it, I believe, and you'll notice Sweet Home Alabama is sampled (and mentioned) there, too.

           Ok, fine.  The original artist is dead, and the rules of sampling cover blatant rip-offs.  I'll just take my Pink Floyd cd's and go...

I am glad Kid ROck is only popular in the USA
althoug one song with some rap with metal was ok.

While I'm not usually a fan of sampling there have been some that worked well.  Sampling isn't stealing though unless it's not cited and credited to the original writers and performers.  There are two types of copyrights in recorded music, (C) which covers the music and lyrics no matter who performs them and (P) which covers the actual recording.  If music is actually produced in some form then it can by covered.  There are standard fees and royalties for performing someone else's work.  There are also fees and royalties to legally use someone else's actual performance (sample).  Usually both have to be paid and the original owner and artists cited in order to publish a new recording using a "sample" from another.  Since whoever owns the publishing and the recordings is paid and contracts signed it really can't be called stealing or ripping off -- but that doesn't imply that the sampler has any talent they just are thieves.

Yeah well I think that the settlement Avril Lavigne had to pay out for "Girlfriend" taught a lot of the industry to pay the royalties and buy the rights - even from long forgotten obscure groups. (For those who dont know there was a "nobody" group in the 70's called The Rubinoos that had a minor sucess with a song called "I want to be your boyfriend", avril changed the gender, updated the chords a litlte , and took a lawsuit right up her pretty lil ass LOL)
