openmindedslave -> Power of attorney? (11/29/2005 6:08:21 PM)

I have heard that some doms are not taking contracts to the level of having a power of attorney over a slave . Basically giving up control of you postions and maybe even your home . Of course this has to be done legally. But isin't that going to the extreme when all real power is totally given up to another. Doesn't that mean the slave is trully of to the whim of the mistress to wether they are allowed to stay or not???

DEAR OPEN MINDED SLAVE, AGAIN, MOI?!?
GREETINGS,
b.s.....
you have, to have your name ,on the lease, b4 you move ,in, with a mistress -no matter where it is -24/7.
westpalm-beach ;wherever ,if you live, together,so there's no ;call the cops later, by her ,or relatives,or xhusbands ,when you try ,to come ,in later,....
of course you have life ins;
power of atty
;lock stock and, barrel,! out side the mom consideration,of course
,but, she has ,to be real...,not someone ,with kids ,or a pimp owned pro,or a homeless indigent minded female, that wants your stuff ;f.u. kinda' thing.
i had a "top" cause she found ,out quick:i was'nt looking ,for anything else, so; who are you lady,is who she was ,to me., ...
and she ran ,in my bathroom; while i was sittin' there taking a caca ,
and, i knew she did'nt know a thing, about s and m ,
and, i wanted her ,out,
and she wanted my house, for her kids!
,so she suddenly ran ,in ,and, stabbed me, in the ,upper arm....
and i freaked,and,yelled ,at her ,and ,
i said what the ....*&%##@!
she said:( crying),:well... . i thot you liked, that!!....you said you liked it!!!
i made the mistake, of talking ,to her vanilla self;trying, to explain what a mistress /dom is, and, she took it litterally.
no foreplay ,either....,just run ,in and stick,me ; like a schitzo family member ;right ,,outta' hell, and, a one-nite-stand,too.(,that would'nt go!)...
,and,later:....
in nyny
babysitter-tops wanted, to toss me, out, for their vagas friends ,to takover the aptm. while my dom was gone.
my dom trusting me,to ,not let them, forget i was ,on the lease ,with her...
,so you have, to be ,on the lease, and, say, so !!!
,in the beginning,
or what do we have here?
a frivilous-relationship?
don't expect any "committments" ,then,
and, power this!
,or be prepared, to be tossed, out ,on a regular-basis ,on a ,socalled:tops' whim ,(there's method ,to their planned maddness, too ;top-whims -my azzzzz....),and ,
if she comes ,to you ,at your place,
put ,no-one, on power ,of atty., unless:
they are a top, to, begin ,with ,
and ,are serious.
there's ,another" top ",out there: who deserves "power ,of atty" ., and, everything-else ,and, more....
i would have had, to give my house away ,over 60 times, if ,that were the immediate ,understood policy ,of every top- bottom relationship
....,in actuality: you have ,to expect the fickle top ,or decietful- vanilla ;doggy style is ,as kinky ,as it gets ;DO-ME-wanna be,
CAUSE THEY ALL took a walk ,
or RAN ,over ,2 my bedroom.
....you give your"REAL- top" everything;
treat her like your dad was supposed ,to treat your mamma,
or you got ,nothing there.
ABOUT THE BABAYSITTERS;they sent a dom over dressed as my absent famous dom to stage an agument so she could hollar me out for the vagas money grubing sleeze,to take, over, but my top briefed me and told me in full here is our legal lease,so if anybody comes and trys to take your place with me.
no lease;no power of atty ,either ,to anyone.

I agree but WHEN will you learn to drop the stinkin commas so that we can actually UNDERSTAND what you say.

Wolf1020 -> RE: Power of attorney? (11/29/2005 9:24:08 PM)

is it extreme? Yes of course. But then agian so are a lot of things couples do. If the slave wish's to be truly owned giving power of attorney is probably about the closest s/he can come to being truly owned in a legal sense.

I would, and I'm sure any other attorney would as well, be surprised if the request was for a non-revocable power of attorney. There are all sorts of safeguards, "hoops" the attorney would have to jump through, to avoid conflict of interest malpractice.

Edited because I missed a comma.

quietkitten -> RE: Power of attorney? (11/29/2005 11:07:54 PM)

There has to be an actual reason for the power of attorney... failing health, mental incompetence... It is not simply granted for no particular reason.

WalterRego -> RE: Power of attorney? (11/30/2005 12:36:31 PM)

If this is a real question (in the sense that someone has asked for a POA from you or a person close to you) you need to check the law of your state.

Most places there doesn't have to be a reason for the POA along the lines quietkitten speculated (for example often people give a POA to another person when buying or selling a house, just because they can't or don't want to be present at the closing). But most places a POA is also revocable, that is you can end it. When acting under a POA, the person acting under it must state or swear (and be able to prove if asked) that the grantor is alive and still gives permission for its use, or if it's a durable power of attorney (which survives disability), that the person who gave it can no longer act for themselves. These sorts of restrictions tend to prevent something like the loss of a residence or enable you to reverse it by proving it was done fraudulently or without your consent.

On the otherhand, if you give a POA for someone to make withdrawals from your savings account, most banks will honor that routinely. So all the money could be gone and if already spent, not retreivable.

My guess is someone who could be talked into giving another person POA in a D/s relationship could probably be just as easily talked into signing over a deed, or simply transferring all their money to their Dom/me. Those situations would be a heck of a lot more difficult, expensive and time consuming to revoke, and possibly not at all.

I just quit reading his posts, which is a shame because I'm sure that he has some interesting things to say, but I just can't do it. I have a language disability and I can't read his writings

I have a POA for my mother, and she is not in ailing health or anything like that. She just wants everything to be covered for her youngests if anything should happen to her. It was rather simple, but I think it may be more difficult for people who aren't related or married, I don't know. Why not ask an attorney?

Not true. Not true at all.
Many people give power of attorney either totaly or limited (to manage certian accounts, run certian aspects of buisness which is in their name, etc.)

I can go to a lawyer right now and have a document drawn up giving someone the power to sign my name to buy and sell houses, manage bank accounts, or outright do anything they want in my name. And I am in fine mentaly and physicaly.

Like I said if a slave wants to be totaly owned giving total power of attorney is the closest one can legaly come to being owned, since the person can do most anything they want legaly with their name.

Though giving power of attorney doesn't remove the persons ability to still do things themselves of course.

Greatcornbow -> RE: Power of attorney? (11/30/2005 2:42:42 PM)

Wolf is right. Powers of attorney don't require a reason, though in some places they are limited in time, e.g. one year, unless renewed.

So a POA, plus a letter of request to be controlled, including whatever you'd like to have in a contract, is potentially very powerful indeed.

mistresspayday -> RE: Power of attorney? (11/30/2005 3:49:42 PM)

how does one get out of the power of attorney if the one who has that power doesnt cooperate? has someone else sign for the certified letter and what not?

siamsa24 -> RE: Power of attorney? (11/30/2005 4:02:58 PM)

There are some basics of POA here

quietkitten -> RE: Power of attorney? (11/30/2005 4:21:07 PM)

I guess I was assuming that things are the same in the U.S. as they are here.... In Alberta there must be a reason for the Power of Attorney.. it is a safeguard against abuse.
Each case here goes in front of a judge, I have been a part of the process a few times and they always required a good reason.

openmindedslave -> RE: Power of attorney? (11/30/2005 8:35:43 PM)

The reason for my question concern a Mistress story I heard about in California. There she was a prodom and found a man willing to give up everything to become her slave. Power of attorney wasdrawn up and a lawyer was involved and was deemed he was of sound mind to agree to this arrangement.
Cut to the chase. She had him living his slave life until one day it was over . His bank accounts very now transferred to hers . His car was gone , home and anything else was gone, and when they broke up, it was all in her accounts ...He had nothing ..but alot of memorys. Later , I heard she did it again to another guy...

Um, as unsympathetic as this sounds, exactly what did he expect when he signed the POA? Happily every after? It's a blank check to access your assets. Treat it like one.

Edited because the lawyer/teacher can't type.

orfunboi -> RE: Power of attorney? (12/1/2005 6:33:11 AM)

i have heard of this, but have never known anyone who actually did it. i can think of only one person i would trust to give POA and i am pretty sure, she would not want it.

Yes it is extreme, and yes you are than dependent on her whims, but a lot of what we do is extreme, and you'd better be pretty sure you can predict and live with her whims before you even think about that.
The other thing which has already been said is that POA is rarely irrevocable, so you can take it back if/when the shan hits the fit. M
