Obama now has so much to prove.  He has to translate "words" into action.  There is not going to be any middle ground for America as we begin the year 2009 with a new very liberal President and a strengthened liberal Congress.  Will the country deteriorate into a polariszed split of left and right?  The ball is now totally on the liberal side of the net, and in two years the democrat party will have to have proven it is more than "anti-Bush"..but a party with solid programs for the economy, statesmanship in foreign policy, for inclusion of all peoples, or truly the party of "re-distribution" and class warfare.
My fear is not from the right, or people like me that are totally upset with the "will of the people" to change the course of America so profoundly, but from the left, the people who wake up Wednesday morning seeing a new sunrise of hope...and having to recognize that nothing is going to change for them unless they do it themselves, the way Americans have always prospered in this country.  In that regard, Obama might be the best role model and messenger or, ....the most polarizing influence on this country since King George.  For all of our sakes, for our children, for our America, I truly hope he succeeds.

I get very emotional when I think that we have a president who thinks that the individual liberties listed in the bill of rights can be superceded by the 'community good'.

well for one, any gun regulation is unconstitutional...

but that's not really the main thrust of my problem. the idea that communities override individual rights is chilling.

it's almost as chilling as how effective empty platitudes and demagoguery are to so many people that happen to live withint he borders of the country I live in...

Do you realize that every judge in the US and every Constitutional scholar agrees with President elect Obama on this point? Do you realize that your other Constitutional rights have always been limited by the 'community good?'

YAY!!!!

When we found out, my whole family went outside to join the neighbors and scream and laugh and hug and dance and just generally freak out. I respect McCain for the very eloquent, heart-felt concession speech. Perhaps if he had spoken like that throughout the campaign, he would have impacted more people.

But my GAWD Obama's acceptance speech was epic! Goosebumps and swells of pride flushed through me! As a first time voter and one of the "college kids who never vote," it was amazing to see so many people came out on either side to vote.

Not only is it a fantastic move forward regarding race, the hope that now shines down on so many people's faces and pours into so many hearts is absolutely refreshing. What got me most was that the ENTIRE world was watching with us. It was not just you, or your family and friends, or even fellow Americans. Humanity as a whole joined us tonight in celebration as we embarked on a path toward the change we need!

Now let's see if we can step up to the challenge...

Community has always overrode individual rights.

Also read the SCOTUS ruling on the 2nd ammendment from this year. Justice Scalia makes clear that he and the concurring majority agree that gun regulation is very Constitutional. Including that your 2nd ammendment right can be permanently taken away by action of a court.

I don't like Obama, I did not vote for him.  I know his election was a big mistake. I am sure he will be remebered as the worst President since Carter. However,  he won the election and the only sane thing to do is support him and hope for the best.


...I fail to see how this is the sane thing to do. I didn't think it was sane for me to support bush last term. I don't think it's sane for me to support obama this term. why would I ever support someone I think is a detriment to my life.

The first time I even heard the name Barack Obama was when my mom (an active Deaniac in 2004, and a Demo PCP until her death last year) called me the day after the convention and told me that she thought that he would be the next president.

What I see before us is an orator, a statesman, a diplomat—something that has long been absent from our White House.

It was a very moving speech, beautiful. It's like waking up from a nightmare: times are changing.

Change is a keyword indeed.  . . . another country just declared tomorrow as a national holiday because of who we just elected.  There will be an amazing shift in foreign attitude (and policy). 

For cynics, they should know that the track history is for Presidents to delivery or at least try to deliver their platform promises.  I don’t think Obama will suddenly turn his cheek on the very issues that got him elected. 

Further, Obama even ran his campaign to effect “change” in our government.  He spent a fortune on some republican stronghold states he knew he couldn’t win.  His support helped those states vote in democratic senators even though they voted republican for the president.  Obama has already put his money where his mouth is and made a change in the balance of power in our country. 

So far:
56/40 senate
247/164 house

…change, I’ll put my money on the fact that “change has come to America” already and the historic value of what happened today has a great deal more than the color of the skin on our new president.

I am acutely aware of the fact that the government has been able to override my rights at every turn.

this goes from wickard v filburn to the kelo decision.

but no, they were not always limited by the 'community good'...though first off, what *is* the 'community good'? is it what the constitution says it is (the bill of rights) or what the supreme court says it is? I propose that full support of individual rights in what is in the best interest of the 'community'.

also, could any of these judges and constitutional scholars give me constitutional support for why obama's opinion is correct?

hint: marbury v madison is not a part of the constitution.

well...Justice Taney makes clear that he and the majority say in their 1787 ruling said that "Negroes, whether slaves or free, that is, men of the African race, are not citizens of the United States by the Constitution."

does this make it constitutional?

and I will pose the same question to you...

where in the constitutional is the supreme court given judicial review?

No. My European ancestors tried to wipe out my Native American ancestors. Conquering has been part of the history of the world for as long as the world has existed but a lot of what happened to the Native American's was because of disease brought here by the Europeans before the thought to enslave them was even attempted as a reality. Conquering any land requires subjugating the people of that land and history is repleat with examples of such actions. That, however, was when we were young and begun before we were even a nation and much has been done to rectify that situation. I'm not going to deny that we, as a nation, certainly have a warrior spirit, often have a bully tendency.  

Conquering .. It was not so different from what we who are of Native American ancestory were doing to ourselves at the time. Tribe pitted against tribe was common and there were no small number of tribes who united with the Europeans to wipe out their fellow man, Native American's, who were viewed as enemies. No clean hands and plenty of culpability to go around on that score.

That's not the same as going to someone's land, stealing them, selling them and forcing them to come to a foreign place in chains and subjugate them for profits. When we finally fought a civil war that was supposed to cease such actions, we still and for generations did everything in our power to subjugate and separate people simply because of their DNA. We came here and conquered .. we went overseas and stole. Conquering, not pretty .. but stealing, thievery  ... that's dishonorable. Tonight we took a baby step in trying to rectify that as well.
