Ill. high court rejects attempt to remove governor

It seems this particular scandal will continue for some time yet. Interestingly, unless/until Blagojevich is indicted, or perhaps even convicted, it's arguable he might even survive impeachment. No Illinois governor has ever been impeached, which could raise the bar somewhat for impeachment efforts against Blagojevich.

At this time, Blagojevich still has the power to appoint a Senator, as well as the power to sign/veto legislation calling for a special election instead.

So the big question is will he use the money from the sale of the senate seat to hire a good lawyer or bribe the jury...or perhaps escape to a non extradition country with his booty.

RAHM EMANUEL | Pressed for Jarrett appointment to Senate

Better question is exactly what DID Rahm Emmanuel say to Blagojevich's aides?

Another good question is when/why did Valerie Jarrett's name get removed from the short list of "preferred candidates"?

At this juncture, however, the more relevant impact comes from the fact that this story will play out for several news cycles yet to come.

He's gone.  He's just being a stubborn jackass.  I remember when Jim Guy Tucker tried this bullshit after his felony indictment here in the 90's.  It's just a pathetic example of denial.

If he's smart, he'll roll with this and milk his current, minor celebrity status for what it's worth.  Wealth through infamy is certainly better than poverty through infamy.  If Marion Barry can do it, so can he.  [8D]

I tend to agree. If nothing else, he's not going to get re-elected.

However, it should be noted that, at this juncture, he's not even indicted. Fitzgerald still has some time to bring an indictment.

Uh, because she'd rather be Senior Adviser to the President than one of 100 Senators?

Funny how you RWers have to create imaginary scandals for the Obama administration.  No need for that in the Chimp's administration--he's got plenty of real ones to choose from.

That is possible.

As for the creation of scandal, Dear Leader has done an excellent job of that himself by dribbling facts, answers, and information out over several news cycles.

He's got no choice,  He's gotta stay on.  He needs to cut a deal giving him some concessions in return for leaving quietly.  If he left now, his leverage would be nil.

He doesn't have a lot anyway.  Even without the corruption, he's made a lot of enemies, gone back on his word after making deals, and hardly shown up to work at all.

According to NPR there is no real definition for impeachment in the Illinois Constitution so he may hid behind that problem for a time.

More accurately, it doesn't define the basis for which someone can be impeached.  I.e., it reads very much like the US Constitution, but it omits "high crimes and misdemeanors".  But the rest of the impeachment process is defined just like the US version.

quote:

The House of Representatives has the sole power to conduct legislative investigations to determine the existence of cause for impeachment and, by the vote of a majority of the members elected, to impeach Executive and Judicial officers.

My take is that the Illinois House can pretty much define what crimes are impeachable, then the Senate votes on whether the charges are proven (just like with the US Congress).

Of course, "impeach" means "to bring charges against", not "to remove from office".  Only the Senate (Illinois or US) can vote to convict, which results in immediate expulsion.

Do you know whether Illinois has any precedent defining "cause" for impeachment purposes?  I certainly feel that he has committed an impeachable offense but if he is just trying to drag it out, just saying "cause" may well generate an appeal. I am trying to recollect Nixon but didn't they basically stick to "high crimes and misdemeanors"?

sambamanslilgirl -> RE: Ill. high court rejects attempt to remove governor (12/18/2008 5:25:24 AM)

in the news this morning:

Blago has a very expensive and well-known attorney (the same guy who represent R. Kelly) and he's asking Madigan to appoint him as the governor's attorney so the taxpayers of IL can pay for his legal services/fees.  stay tune for that drama.

the attorney did appear in front of the impeachment committee and called it a "witch hunt" meanwhile Blago's dying to speak to the people of IL to present his side of the story ...i have the exclusive tidbits already:

"Good people of IL, I'm bleep innocent ...those bleep Feds have bleep nothin' on me!"

I can see it now $2 million advance to write a book about corrupt Chicago politics. That will make how many 60...100 ?

Otherwise, this whole thing is subject to the Ill., consitution which as I understand it is being followed by the Ill. state courts...so far.

Come on!!!  Are you trying to convince us that there are people in Illinois in politics who actually follow the law?  Well that will be a first.

Yes, what a SCANDAL!!!

Potentially, a most embarrassing one.

Time for a little "what if" speculation.

18 USC §4 Misprision of a Felony
quote:

Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both.

Now, from the article linked in my last post:
quote:

Emanuel privately urged Gov. Blagojevich's administration to appoint Obama confidante Valerie Jarrett, and the Sun-Times learned Tuesday that he also pressed that it be done by a certain deadline.

Jarrett was initially interested in the U.S. Senate post before Obama tapped her to be a White House senior adviser, sources say.

Now, "what if" Emmanuel knew of Blagojevich's solicitation of what amounted to a bribe?  "What if" the transition team opted to just look the other way and ignore the governor's corrupt scheming, knowing full well his intent to essentially auction the Senate seat to the highest bidder?  Did they conceal that knowledge--thus potentially putting them on the wrong side of 18 USC §4?

Merely refusing to go along with the governor's scheming is not necessarily enough to stay on the right side of the law.  If Emmanuel winds up pleading guilty to misprision of a felony or denies the wrong thing under oath and gets caught committing perjury, then Blagojevich's corruption will have managed to infect the very core of Dear Leader's administration.

This is what Dear Leader sustains by his pathetic inability to marshall facts about his own transition team.
