That is definitely an area of legal detail I can't speak on, but given the Federal Government opted to try Mr. Little in Florida—even though his production was based in California—that might give some indication about how sympathetic the judicial system is in Florida, as opposed to say, Arizona, where a similar conviction effort was tried but failed. Only an attorney specializing in Florida law would know for sure in regards to the opening question. That said, I'd be inclined to think the powers that be would be more interested in going after the provider, not the individual buyer. It's probably worthy to note that millions of purchases and downloads of adult material happen every day without legal ramifications in any state, but they can and do happen. Justice Stewart's, "I know it when I see it" encapsulates the ambiguity of so-called "obscenity" pretty well. One thing for sure is the notion of obscenity can be exploited to suit a moral agenda by state entities, and given the political climate of the past eight years, it has been an even greater concern. I remain optimistic about the future, however.
