about downloading bondage films or even mentioning the word in e mail and such. I would like to know if bondage and spanking etc. Is legel in Florida?.. In this state they will throw you in jail for about anything. Thats just my view.. Maybe there are a few attys out there that can advise.. Thanks Vince

Are you referring to Mr. Little's obscenity case being convicted in Florida's environment of "community standards"? If you want to get technical, you'd be quite shocked to know how precarious it is to be involved with such things in any state, even more so as purveyors.

Nonetheless, I wouldn't worry too much, for a few reasons:

1. Barring content involving minors, the DOJ usually goes after big fish, not individual downloaders;

2. The current administration and its judicial agendas, thankfully, will be ending soon.

That said, it remains to be seen what change of "moral" flavor the new administration will bring to the Department of Justice, or what special "task forces" within it will be enhanced or disbanded. Time will tell.

Ummm, yeah but what about at the state level?

I agree with your points about Bush and the Jesus freaks...do I ever...but what state laws affect citizens in Florida directly?

I never lived in FL, but it's something to think about. Crap, now i'm curious about my own state, lol.

There is some safety in going "old school" and using a secure usenet service for downloading. Many usenet servers do not keep logs and with an encrypted connection it's hard for the ISP to tell what you are doing. Google usenet to find services and reader software.

For the past 5 yrs that I've lived in FL I've DLed all kinds of porn..bondage, water bondage, etc etc etc.   Nobody has come kicking my door in yet.  

As long as youre not DLing kiddie porn, you should be fine.  There are bigger fish to fry.  

If you want to know what kind of trouble you could POTENTIALLY get in to, try googling Florida / internet / porn / Download...

A fair point, Isaac.

That is definitely an area of legal detail I can't speak on, but given the Federal Government opted to try Mr. Little in Florida—even though his production was based in California—that might give some indication about how sympathetic the judicial system is in Florida, as opposed to say, Arizona, where a similar conviction effort was tried but failed. Only an attorney specializing in Florida law would know for sure in regards to the opening question.

That said, I'd be inclined to think the powers that be would be more interested in going after the provider, not the individual buyer. It's probably worthy to note that millions of purchases and downloads of adult material happen every day without legal ramifications in any state, but they can and do happen.

Justice Stewart's, "I know it when I see it" encapsulates the ambiguity of so-called "obscenity" pretty well. One thing for sure is the notion of obscenity can be exploited to suit a moral agenda by state entities, and given the political climate of the past eight years, it has been an even greater concern. I remain optimistic about the future, however.

It's the scariest thing on the planet that someone elses' idea of morality can get you in jail.

For example, people seem to think the human body, in any form, is immoral. They have this idea that anal penetration is immoral. They think a man paying a woman for sex is immoral. A woman asking to be spanked is immoral. Hell, even a diagram on a piece of paper is considered immoral if they object to the content!

What scares me is that these people are our accusers, judges, and juries.
