One night, a police officer was stalking out a particularly rowdy bar for possible violations of the driving under the influence laws. At closing time, he saw a fellow stumble out of the bar, trip on the curb, and try his keys on five different cars before he found his.

Then, sat in the front seat fumbling around with his keys for several minutes. Everyone left the bar and drove off. Finally, he started his engine and began to pull away.

The police officer was waiting for him. He stopped the driver, read him his rights and administered the Breathalyser test. The results showed a reading of 0.0. The puzzled officer demanded to know how that could be. The driver replied, "Tonight, I'm the Designated Decoy."

There's a small town in WI where the Designated Decoy has been used often enough to have a law passed in said small town to include the use of a Designated Decoy as a form of impeding justice and is a fine-able offense. Ya gotta love small towns in the midwest...the cops have no sense of humor.

Technically the cop could do two things to give the decoy a hard time.

For one, he could still haul the guy in for driving under the influence of alcohol AND/OR drugs. This means a trip downtown, waiting for the results of a urine test and posting bail, getting his car out of impound, all that fun.

He could also charge him with obstructing justice, which may be a felony even if the DUI would not have been. That means alot more bail money for one, and has a few other ramifications. One of them is that the charge is not likely to be reduced. Well maybe to impeding an investigation. Perhaps even supplying false evidence, no matter that it was against himself.

Each is defensible of course, but that means lawyer bills for most people.

A nice joke, but is not a good idea in practice.

I didn't mean to get serious here in humor, but someone else started it.

I have actually been a Designated Decoy, the problem was that I was drunk as hell at the time :-)

My best mate is profoundly deaf with cerebral palsy - you should see the problems we have just getting him into the pub, never mind back home! All the bouncers think he's already had a skin full and refuse him entrance to the pubs.
