Cagey18 -> Senate Democrats move toward seating Franken (1/21/2009 9:46:22 PM)

Wed Jan 21, 7:33 pm ET

WASHINGTON – It's no joke: Senate Democrats are moving toward letting comedian Al Franken join the chamber while Republican Norm Coleman's election lawsuit is pending.

"We're going to try to seat Al Franken," Senate Majority Leader Harry Reid, D-Nev., told reporters on Wednesday, a few hours before he posed with Franken for photos just off the Senate floor. "There's not a question in anyone's mind, an assertion by anyone, that there's been any fraud or wrongdoing in this election."

Coleman's lawyers are challenging the results of the election and the re-count in a trial set to begin in state district court on Monday. A three-judge panel that will hear the case is considering Franken's argument to dismiss it altogether.

I hope they do, since he won the election.
I loved Al Franken's books even before I knew he had such political aspirations.   M

Absolutly, why should the Courts be allowed to rule on such things....

MmeGigs -> RE: Senate Democrats move toward seating Franken (1/22/2009 4:18:25 AM)

The Senate can't seat Franken without an election cetificate, and the State of MN isn't going to give him one until the court challenges are decided.

DarkSteven -> RE: Senate Democrats move toward seating Franken (1/22/2009 5:26:22 AM)

What is with Reid?  He doesn't want to seat Burris, he wants to seat Franken... Why doesn't he just quit doing what he wants and let the laws determine?  We've had eight years of an idiot breaking laws right and left.  Can't Reid just shut up and do his job?

DomKen -> RE: Senate Democrats move toward seating Franken (1/22/2009 6:56:11 AM)

The Senate is the judge of its members elections. If they decide Franken is the senator then he is the senator.

Finally, a real liberal in the Senate.

Irishknight -> RE: Senate Democrats move toward seating Franken (1/22/2009 12:06:33 PM)

Sorry, I thought this thread said "Frankenstein."  I was looking forward to a series of films like "Congress Meets Frankenstein" or "Dracula vs Pelosi: Battle of the Bloodsuckers."  Damn!!!

You're wrong about this. The Senate can refuse someone's credentials, but they have to wait until the state has certified the election and issued the credentials before they can seat someone.

No. Article I section 5 of the US Constitution
quote:

Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members

IOW Franken is a Senator when the Senate decides he is. Actions by the state of Minnesota regarding the outcome of the election do not have to honored by the Senate. There is some debate as to whether an appointment as just occured with Burris is subject to the same rule but for elections it is ultimately the Senate's decision.

awmslave -> RE: Senate Democrats move toward seating Franken (1/22/2009 5:19:26 PM)

Nice to have a true comedian in senate. Harry Reed kind of pretends to do stand-up comedy every time he opens his mouth.

Owner59 -> RE: Senate Democrats move toward seating Franken (1/22/2009 6:22:33 PM)

The vilification/degradation of Reed and Pelosi isn`t work`n out, guys.

Just so you know,no one knows what the fuck you`re talking about.

Neither of them have the sex appeal that Newtie or that bigot hugger Trent Lott did. Those two have more yawn appeal than anything else.

So the Senate can just decide who the Senator is from each state, no need for an election at all, is that what you are saying Dom Ken?   I think Mmegigs, makes more sense.

Amendment 17  "The Senate of the United States shall be composed of two Senators from each State, elected by the people thereof,....."

The Senate has the right to reject the election results for cause....not to just decide who they want.

Read the Constitution. It's pretty black and white. The Senate is the judge of who is elected to the Senate. They don't need cause to reject a Senator. They simply need a majority vote.

So are you hoping people won't notice you switched to refusing to seat a senator(which is what I just argued) , from deciding whp won, before the state certifies the election (which you previously claimed as thier right under art I sec 5)?

Is that a comedy homage to Franken?
It is funny when someone does a full 180 on what they are saying, yet pretend they were right all along.  Lot of comedy based on that over the years.  Al is a master at it.

I'm hoping nothing except that you won't try and twist my words again.

Once more if the Senate decides that Franken is the junior Senator from MN, no matter what the courts or state government decides, he is the junior Senator from MN.

I mentioned rejection becuase you did. I did not change my argument at all.

ArticMaestro -> RE: Senate Democrats move toward seating Franken (1/22/2009 9:11:11 PM)

Damn, Reid should get with it then, and kick out all the Republicans, since he has that power.  Wierd, how no one ever noticed it before.....It can be used for cause, if there is a dispute or the Senator doesn't meet the qualifications.

But this thread is about seating someone before the Election has ended (And Democratic Congressional leaders who think they have more power than they do)....Hence the power to reject has no bearing...at all...

You know Maestro, your writing style, expressions and other "qualities" remind me of another fella from Anchorage named Luckydog.

His account went inactive, just as your`s was opened.

Is that you,lucky?
