No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States which shall have been created, or the Emoluments whereof shall have been increased during such time; and no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office.

hillary was a sitting member of the senate during a period of time where there was a pay increase for the secretary of state...

so anyone who was a sitting member during that time cannot take a position until the end of their term (which is not for a while).

does anyone care?

does anyone think this will matter?

5USC5303 automatically raises the pay for some politicians...but...

executive order 13249 upped it as well. I also think hr2764-2 did it as well. so yeah.

obama tried to use the saxbe fix but that doesn't get around the issue. he, as a constitutional scholar, should know that the saxbe fix doesn't wash away this.

but he also knows that no one will care and he can do whatever he wants to despite what the constitution says.

Seems to me that those who can do something about it don't care or can be made to not do anything about it and that everyone else just has to endure the continued ravishing of our rights and sensibilities. Personally, I'm sorry to see that that particular person is at all in line to be my President.

it does not take a obsessive study of the constitution to bring about a critique of this administration...or the last one...or the one before that.

In a simple answer NO!...If there weren't a mechanisim prior to now, to bypass this....she wouldn't be there...nor would a number of Senators and Congress members who have served in prior administrations.

Just sounds as simple as you have to quit one job before officially accepting the other. It's probably not that simple, but that would make sense. As for care? Not really. Even though I didn't support the new administration from the onset, certainly doesn't mean I wish it to fail, quite the contrary, I wish them success, to do otherwise would be counterproductive...whoever needs to be in whatever job to reach the envisioned goals is of primary importance at this point.

nope. the more and more bush did things like regulate the economy (our market is quite a bit more regulated after 8 years of bush) or thrash civil rights (he rivaled lincoln as far as his disrespect of citizen's rights is concerned) the more and more egregious the actions became.

what this part of the ocnstitution says is that you have to wait for your term to be up before accepting another civil job (if that jobs pay increase went up while you were sitting). this is to prevent people from voting up a pay increase for a civic position, then resigning and taking the position they just made more lucrative.

I actually differ. I wish failure upon this administration just as I wished it upon the last (and the one before that). why? people aren't going to learn from their mistakes through enlightened studies. they are only going to learn through discomfort or pain.

for instance. people may have thought that taking advantage of low interest rates to buy things beyond their means was a great idea until they were caned by an economic reality. now they've learned their lessons (unless they are bailed out, in which case their failures are subsidized and they keep on trucking). people may think that trusting the SEC to police the market is a good idea...but after they lose their fortunes, they realize maybe they should have turned to a private due diligence firm (like aksia llc, which saw madoff for what he was years before the government caught up).

people are only going to learn that a horrid monetary policy, inflationary policies, socializing industries, ignoring the necessity of a production based economy, and a nation relying so heavily on debt to fund its bloated existence is a recipe for disaster after the bonds market fails and the dollar is worthless (as is US debt). once you see your wealth reduced to nothing because of the incompetence of central planners, then you'll learn your lesson. I want people to learn their lesson...so I'm overjoyed when I read about obamas plans for the economy.

In My opinion, people who are "about to finish their... education" should be locked in a cage with no access to a computer, television or newspaper for one year... they know just barely enough to be dangerous.

Said with humor because since Obama was inaugurated I can't seem to stop smiling.

No, and no.

None of that matters in the big picture to me, or the welfare of the coutry I love. Certainly not to the extent of the constitutional attrocities that our 43 president and his cohorts commited and found ways to validate with lies and half truths.

[I'm reading Mises...]

Well you caught my attention. Hilary as SoS, unconstitutional! Fascinating. When you think he(Obama) took the oath twice, then, if your correct, it would matter to him. Not being American myself I'm not familiar with the minutia of your rules and regs for such matters. But what about the Presidency? Was Obama a sitting senator when the the President's pay was decided?

By the way "Mises" title or author? This reference was more obscure than the regs quoted.

ps This is my first ever post. Have I used the 'Quote' facility correctly? If not any pointers would be welcome and well received.
