Is pro-Domming legal here in the US?

I just moved here and saw that there are a lot of pros on this site.............wondered if it was actually legal here.

I'm not a pro, but I think it depends on if sex is involved. If sex is involved (in any form - masturbation, with toys, receiving oral) and money changes hands I believe most places in the US could classify it as prostitution, which is generally illegal. If someone wants to be bound, that's legal in most places. If someone wants to pay to be a service slave and clean or do housework, that's legal. If someone wants to pay to be verbally humiliated and spanked, that's legal. If someone wants to pay to be tied up and trampled, that's legal. There's a lot that falls under the category of domination that also falls under the non-sexual category

So in and of itself, being a pro Domme isn't illegal. Neither is being an escort (which is why you can find escort agencies in the yellow pages), but the general assumption is that escorts offer sex to clients (which is illegal in most states), and since a lot of people don't understand domination they assume that pros are escorts who offer kinky sex (which is also illegal in most states) instead of just the kink. I'm sure they exist, but I have yet to meet a pro who offers sex as a service

its fuzzy every state is differnt...its best if you check the law where you live and if you are thinking about doing it professionally then pay a lawyer to sitdown and talk with you.

It's a bit fuzzy depending upon where you are. The first point is that it is illegal if sex is involved, and then that's where it gets fuzzy because the location where  you are at may define it as prostitution even if no sex is involved because they run it through a moral filter where someone you don't know gets to decide what is and is not moral, and thus what is legal and not legal. In the end, if you have enough patience, you can fight the illegality of the charge, but it may cost a lot of money that they may use the resources of their local government to railroad you into compliance or desertion.

As I recall, prostitution is legal in licensed brothels in Nevada, but nowhere else in the US.

Oh, well, that all depends upon a near infinite considerations, but one good thing is we aren't under the tyranny of King George and the Army of Jesus.

There's still sting operations and task forces out there looking to see if they can nab a girl getting paid to have sex. Whatever you do, pay your taxes.

That was actually done in the House by the Republican Whip, who wants all the action for himself.  The Republicans, not surprisingly, have never had a female Whip.  Fun fact: Nancy Pelosi was the lone woman to ever be a Whip (which is what she did before she was Minority Leader & Speaker of the House).

I could definitely picture Pelosi with blacks boots and a whip. She is definitely a power tripper and likes to have total control. For her age she is kind of cute too.

I also recently read on a law forum that there is no way for a person to legally consent to "abuse". According to the "attorneys" I chatted with there is no contract that can protect the Dominant. This supposedly is to protect people from domestic violence (so that they aren't signing a contract under duress).  This seems entirely unfair because I believe that is precisely what boxers sign-up for, only they're consenting to worse. I'm much less likely to cause brain damage than a prize fighter. *sigh*

Furthermore, I can't get a straight answer whether it is illegal to have the submissive insert an item while control it remotely.

It varies state to state.  I attended a know-your-rights session ISU Cuffs put on two years ago, when I first came to Iowa.  Pretty much everything in Iowa is illegal, because you can't consent to jack shit.  On the other hand, at least in university towns, very little is prosecuted.  The Ames police explicitly said that if called to a residence they looked at the furniture.  In domestic disputes, furniture got broken.  In BDSM scenes, everything was tidy, even if the person was bruised up.  Something to bear in mind.

SmokingGoddess...  unfortunately there aren't always straight answers to these things.  Sometimes it comes down to what a DA could get indicted and what a jury would convict.  Unless you can cite a case where a judge/jury found that the case you are referring to was NOT a crime, then IF strap on play would be considered a crime, I would assume that what you have described is as well and proceed accordingly.

New York law says it's legal as long as there is no "sexual contact".
However, the definition of "sexual contact" is a big fat gray area. I know someone who got busted for sticking her toe in a slave's mouth - they considered the act "penetration" and therefore sexual.

I require my submissives to fill out a consent form. I'm not entirely sure how thoroughly that covers me, but I doubt an undercover cop would sign it.

Look up the word "government" in the dictionary. It usually says "to dominate". Does that mean since we pay them money (taxes) to dominate us they should be arrested for that? It does feel a lot like rape. [:D]
