barelynangel -> Tax question (4/10/2009 4:40:26 AM)

Okay so, if you have a Man and woman living together sharing expenses and whatnot, and then they add a slave to the mix and provide said slave with free room and board, clothing and necessities -- pretty much expenses etc.

Can those expenses be a deduction on taxes and if so, how would you claim them? i don't know much about taxes lol but aren't you allowed to deduct expenses for live in help and such?

Live in housekeepers are paid a wage, and issued a W-2. You can't deduct expenses when you aren't paying them.

And they don't qualify as dependents, those would be ums under the age of 23 still in school, or elderly, or any family member with severe illness who you take care of.

barelynangel -> RE: Tax question (4/10/2009 5:25:03 AM)

Ahh. So room and board and expenses wouldn't count as payment for services rendered?

servantforuse -> RE: Tax question (4/10/2009 5:58:33 AM)

If room and board are a payment, they would also be income for those recieving room and board. That income would be taxed.

servantforuse -> RE: Tax question (4/10/2009 6:05:06 AM)

I think another example would be someone in child care. If you watch a child for say $300 per week, the parents of that child can deduct that on their taxes. The person watching the child would have to report it as income. If they make a deal to babysit for say $200 per week and skip the deduction, the sitter would be paid cash they could avoid the IRS. You can't have it both ways...

OrionTheWolf -> RE: Tax question (4/10/2009 6:05:27 AM)

~FR~

If you issued a w-2 to your slave for this, then the owner of said slave would be paying the taxes anyway for the slave.

DarkSteven -> RE: Tax question (4/10/2009 6:09:31 AM)

You are essentially in a situation where you should be charging rent, and would then report that rent as income.  You are however choosing to NOT collect rent.  That simply means that you have no income from said slave.  No income, no taxes, no tax deduction.

pahunkboy -> RE: Tax question (4/10/2009 1:26:06 PM)

1.  if they claim their self- or the parent does -no.

2. must be under certain age- or family member as head of household status.

3. if any of the 3 are on programs- it can get sticky.  -food stamps and the like.

4.  if your hobby brings an income- some expense could offset it.

BTW- you really should have it wrote up- that slave dwelling is only the room.  NOT the entire house.  if there is ever a problem- like an arrest- they will cart out stuff of yours - being that you all are same household.

The income tax would be just the beginning.  There are also the employment/self-employed taxes to be paid (FICA and medicare).  Those are about 14%.  Who pays those depends on whether the person is an employee or a contractor, but they do have to be paid.  If it's determined that the slave is an employee, one could get dinged for not filing and remitting payroll deductions.  If slave is determined to be a contractor, one could get dinged for not filing a 1099 in a timely manner (by Jan 31).

All in all, this is a bad time for wage-earners to be fudging on taxes.  The IRS has been cracking down on this group for the last few years, looking carefully at taxable benefits (for example, employer-provided cell phones/blackberries/internet access) and at deductions.  Were I to be fudging in some area of my return, I'd want to be sure that I could make some kind of argument for its legitimacy and that the rest of my return was absolutely above reproach.  I'd want to be prepared for someone to ask questions about the fudged bits, and for them to disallow my deduction and send me a bill for additional taxes.  The IRS may be less of a concern than one's state dept. of revenue.  Many states piggyback on the 1040.  It's been my experience that the state is a lot more picky about things, and a lot more likely to follow up on them and to get other departments involved.  In the OP's scenario, that could get pretty ugly depending on what one's state employment laws and political climate are like.

To sum up, I would recommend that the OP not attempt to deduct these expenses.

Does said slave work outside the home? maybe you can use said slave as a dependent , if you are providing room, meals, clothing and other necessities.

barelynangel -> RE: Tax question (4/10/2009 4:41:10 PM)

First of all lol its not for me i ask this question, secondly i am not asking how to ILLEGALLY claim a slave or fudging on taxes, geesh.

I appreciate those offering insight. What i was thinking of is in-house help, which techincally room board and expenses could be considered a type of payment you could get a deduction on if you had someone live in. I mean there are things in this world you are able to deduct if you pay for service or whatnot. As i siad i don't know taxes, and thought by my scenerio someone could pinpoint what i was thinking about on doing their taxes through a deduction.

If the slave is working outside the household, s/he can file their own taxes. The original couple can keep their regular status.

Dependents is usually family members, including underage cousins, nieces, nephews or elderly member or those with a serious illness (including mentally ill siblings). The trick is that they have to be residing with you.

I recommend going to a EA (Enrolled Agent) at either HR Block and Jackson Hewitt to get the nitty gritty ironed out.

Edited to add, from past experiences with kittnsol and her deciding to make things personal, she will be back to respond and since i don't feel like dealing with her crap and so many people have offered insight to my question, i won't return to this thread.

Feel free to continue the discussion but i have what i need from it. Thanks all who responded, grins even in the belief of the thought was to fudge on taxed.

Fuck no!

What have you been smoking honey?

Live in help (that you also pay FICA, unemployement insurance and proper withholding....sure)....but a lifestyle slave that you buy his or her food and an occasional outfit....get a clue.
