chainedupnick -> Hypnosis and law? (2/1/2006 2:01:33 AM)

Does anyone know how easily it is for someone to take using hypnosis on a sub as "non-consentual"? Esp. in Massachussetts?

Thanks everyone who responds :)

I would recommend that you get the Sub to sign a release in advance. Remember that you can not get someone to do something under hypnosis that they would not do normally. Hypnosis will not change their moral codes or their ability to determine right and wrong unless you introduce certain drugs to the equation (which is definetely illegal).

Lol to be honest I'm more worried about the MA courts allowing a lawsuit with hypnosis as the case than actually winning or losing the case. What I mean is how likely is it for the courts to accept such case?

Basically the problem I want to be a sub but this one Dom who's considering me is a little concerned about my parents using the "hypnosis" issue as "coercion."

Any thoughts?

You need to be talking to a lawyer about this, if you're that worried about it.

lol I know. I'm kinda hoping there's a lawyer somewhere on the messageboards who knows something about it. Thanks for the reply, though.

There might be, but keep this in mind—free legal advice is worth exactly what you paid for it [;)]

Good luck!

im not a legal begal, just a curious bitch,
my question is;

if you are of legal age to consent, im assuming you are. What the fuck have your parents got to do with what you consent to?

Parents involved in sex is a no go area for me. im curious why yours are in your equation?

And if its your Dom that is concerned, god knows why, but anyway, as THE Dom, HE should be the one researching all aspects of his playing field, not the sub surely. Thats like you looking up the technique of 'blank' for Him. i just dont get it?

Sadly, all too many people are willing to claim qualifications they don't have and often give bad advice. The good advice is to contact a local attorney. You get what you pay for. If you want the name of a kink aware attorney in the Boston area, email me.

The only possible danger I have found with hypnosis is when some subjects have the subconscious belief that they must obey any and Every suggestion given them. If you would know you had this kind of subject ahead of time, then I could see some culpability on your part. If you didn't know, then you would probably be as much to blame as a waiter that served someone a food they were allergic to.

[but trust Me, when the wrong person uses hypnosis this way, I have seen some horrible things come to pass...]

P.S. on a side note, does anyone know how to get rid of the "vanilla" designation that shows up by my screen name here?

B1gbear -> RE: Hypnosis and law? (2/1/2006 6:21:39 PM)

I do some dabbling with hypnosis and I will tell you the very first thing I learned is that hypnosis can not EVER make you do anything you would not do or desire to do otherwise. It is suggestive comments to encourage desired behavioral changes, not a trick to make you do something you would not otherwise concent to.

I have no idea of the legal ramifications, but anyone knowledgable will know that you can't be forced to do something non-concentual through hypnosis. You would simple come out of hypno if you were pushed to a place you were not comfortable with.

w/e a person might say under hypnosis its likely not to be acurate also...

hypnosis only happens if the person is willing to do so

Its all Power of Suggestion

not meant to be used in court system

To clarify, for the overwhelming majority of people alive(99.9...+%), no, they can't be made to do anything they don't wish to do.

BUT, Yes, there are some people who, because of their subconscious belief system, can be made to do things that they wouldn't do while not in a guided hypnotic state. I have met more than a few of these people and have seen a couple of them taken to places ( both mentally And physically) that were more than a little scary.

Using the standard hypnosis techniques, it is true that most people will only do things they would normally do. However, in the hands of a trained professional with access to suitable equipment and space. The vast majority of people can be induced to do and say anything. This requires their psychological profile to be modified and the normal protective barriers to be removed by either the use of specific drugs or “brain washing”. (just keep the chainsaw away from me or I’d be tempted to remove the brain, wash it with laundry detergent, hang it on the line after modifying a number of synapses to trigger to my commands). The majority of those subjects are likely to spend the rest of their lives in a state of paranoia and suicidal. Those who are able to maintain a sense of their own identity will in the most part be destroyed mentally so they sink into a vegetative state.

For some people, yes those extreme measures are needed. For some( a very, Very small minority) all it takes is any fool with even a sliver of hypnotic technique.

Just my observation and experience.

I concure.
