I'm not a gun nut, but doesn't it seem wrong to receive a two-year jail sentence for simple possession and accidental misuse (shooting oneself in the leg) of a firearm?

Yeah cb, I do feel it's excessive. Not sure if they're trying to make an example of him, or if everyone there faces such.

Him being a dick doesn't help, I'm sure.

A radio commentator said today that the average jail term for such an offense is 3.5 years. This might make some sense to me if it was in relation to a greater crime or came on top of a pre existing criminal record.

According to this article, if he was convicted in court, 3 1/2 years would be the MINIMUM jail term.

I assume that the stiffness of the sentence reflects a desire to cut down on gang activity.  He DID bring a concealed weapon into a crowded public place.

NYC has very stiff gun laws. In Florida it would be considered an excessive sentence, in NYC it isn't.

In my time we used to laugh, when Barney Fife shot himself in the foot, I think the police in this country are outta hand

Twenty years ago it'd make the newspapers and people would laugh at him and send him on his way.
It sounds racist to me; "a black man with a gun."

so, if the minimum is 3.5 years, why didn't he get 3.5 years or more?  Now, I'm all for the right to own a firearm, but, the law is very simple.  Where is was at, it is illegal to have one, it's also illegal, even in the most "gun friendly" states, to take one into a bar or nightclub.  It's not a question of "is that law right or not?", that's entirely academic.  He broke the law, end of discussion, period.  Why didn't he get the minimum sentence or more?  That's what I want to know.

Plea deal. The rich and their lawyers can often broker a better plea agreement than the minimum sentences required, otherwise there'd be no incentive to plead guilty.

True... I was actually leaning toward the whole "celebrity" thing, but, that makes sense too.  :)

Trials are expensive, BK. A celebrity trial takes weeks and wastes money and court time.

But NYC has had more than one nightclub with a nut shooting off a gun or lighting it on fire. So just saying nightclub and gun will cause the D.A. to go ballistic.

Theses guys need to relize that their celibrate not only has effects on them but the fans that worship them, I think they all are a bunch of spoiled children that needs to grow up..

The last I saw, he was not charged. And like you, I'm still waiting for an explanation why not.

A few years ago a friend called me in Michigan and was incarcerated in Florida for drunk driving and having a pistol in his car.  I called the Florida prosecutor to see if he needed an attorney which I thought he did.  The prosecutor laughed and said "Your from Michigan so you think I am warming up ole sparky about the gun. Tell you what, if he pleads to impaired driving I will drop the drunk driving charge and the gun charge." I was stunned.  Then, he went on to opine that everyone carried a pistol in Florida and that he did not have enough time."

In Michigan my friend would have probably lost his driver's license forever and at least been convicted of a felony.  In Florida, nothing.  In New York a conviction with prison time.

Hey didn't a Vice President shoot someone in the face? ..... How much Jail Time did he get? I can't remember.

By the way the Plea deal was because it would be too easy to continue the tril forever cause of how difficult it would be to find a non-bias jury.

I say shooting yourself in the Leg is bad enough having to go to jail for it and knowing that you will have to tell people that this HOW you got caught.

Man that would suck.
