I'd have to have more information to be able to give a decent answer. Is it a temporary contract....1 year 2 years....till death do us part...Is the contract for slavery or submission? If it is a slave then is the slave signing for it self or it it rather a transference of the contract....Yeah most people are like WTF with that question, but understand that there are slaves that do want that type of treatment. So I would have to say yes it can be seen like a prenump, but it is going to vary greatly on the context of why is there a contract.

As to the why there can be various reasons. Some Doms use it as a tracking method....i.e. year one as a sub/slave these are your hard/soft limits. Year two they have gently changed some raising some falling lower. Some sub/slaves like this in that they see this as the final point of which they now belong to another. Perhaps seeing that up until that point, they were training, and now are finally accepted.

Theses are only a few examples there are a great many, since each person has their own opinion.

Trust is one of those abstract concepts that is just about impossible to nail down from one person or couple to the next. Not only that but people will layer different levels of trust within the same relationship. There are kinky couples who play in a way that the submissive will consent to edge play where the submissive is literally putting their safety or even their life in the hands of the dominant yet the submissive will not consent to allowing the dominant to photograph or videotape the encounter.
