Status: offline 		The "legal" blood alcohol levels are usually done at the local hospital, drawn in the emergency room by staff phlebotomists or nurses, kept in a chain of custody, and the actual test run on very expensive, properly maintained and calibrated chemistry analyzers, by certified laboratory professionals.

So from what I gather, there's a group of cops floating around with limited amount of medical knowledge who will forcefully throw you over the hood of their cop car and (under certain state laws) draw blood from you?

There's too many variables here. Cops are not doctors, they're not nurses. They could possibly inject air into a vein while forcibly holding someone down to draw blood. Plus the fact many people have mentioned the chain of evidence that could easily be falsified.


I'm not comfortable with some moron who can't even control a domestic disturbance holding that kind of power.

Sorry. That's just me.

Status: offline 		Refusing to take a breathaliser test is usually a conviction in Wisconsin as well. The law is called "implied consent". If you refuse to take one, you have implied that you are over the limit. Except for a rare instance, it usually holds up in court.

Status: offline 		I'm at a total loss here.  It's legal to refuse to take a breathalyzer test but not to refuse someone taking your blood?  How did the Idaho Supreme Court figure that?

Status: offline 		As a former officer of many years I do not support police officers out in the field or even at the jail doing so. Most states do have the "Implied Consent Law" in place....refuse the test, whether convicted of the DUI or not, you will lose the priveledge to drive for 180 days, conviction or not, simply because you refused the test.

im agreeing with you from post one. i dont see how you can train an officer, with no medical knowledge, do do a venipuncture in the field safely and effectively, then be able to prove chain of custody afterwards sufficient for a court of law.

too many things can go wrong. a split vein, the needle breaks, hitting an artery instead of the vein, a combative patient... ugh... jst too many problems for this to ever be allowed.

Yeah, we could try THAT for a year or two (as the article states) and see how THAT goes. I'm for the syringe thing. I also think they should just do random anal cavity searches too, ya know, just in case. They can never be too invasive or violate our rights too much. Status: offline 		  This is just crazy!! In IL, it's an automatic forfeit of your license (180 days) to refuse a breathalyzer. It gets the person from behind the wheel, which is the desired result anyway (to anyone who complains about conviction without proof, why didn't/wouldn't the driver take the breathalyzer??).

This is groupthink gone crazy!!!

This makes the assumption that all assumptions of the police are accurate. Remember these folks (LEO's) are trained in the ways of tricking alleged perpatrators and/or offenders into giving up their rights.

It takes around two hours per pint ( A UK pint is bigger than a US pint ) for beer to quit the system. Wine takes longer, although all this varies depending on body size, tolerance to alcohol, food intake before hand ect ect.

Count me in, Steven. If a person can refuse a breathalyzer test, even though they forfeit their driver's license for several months, I can't see how any reasonable state legislature demand that someone who has no medical degree can force someone to allow some cop with limited medical knowledge to forcibly hold someone down and draw blood.

This is one effed up mess, imho. I hope at some point any state that has approved this practice revokes  the policy or has their asses sued off when some cop injures someone.

And hey...if some cop pokes himself with the same needle he drew blood  with and gets AIDS, from someone who might have it, then it's his / her problem. And they should not be allowed to sue the person they forcibly drew blood from.

I live in Idaho, near Boise, and saw this on the news a couple of nights ago. As I remember it the officers taking the blood do have to take a course in the proper way of doing so. Also, the blood will be taken at the jail...not in the field at the site of the traffic stop. That way, if extra "help" is needed in holding the prisoner still they won't have to wait for extra squad cars to arrive.

I thought it was a stupid idea when I saw it on the news, and still do thnk it is a stupid idea. The good thing is, I don't drink, so shouldn't have to worry about it either way, but with the mentality of the local officials, who knows?
