I think we are missing the constitutional issue here. The constitution forbids the imposition of cruel and unusual punishment. Spankings for felony convictions is not necessarily cruel...but it sure is unusual.

Let's get the Supreme Court fired up!



Not exactly as these were not officially sanctioned punishments.

Consider this statement: The government cannot abuse or deny your civil rights. The reason for this is that when and if your rights are abused or denied it is not the government that is doing such. It is instead the individual/s that are doing such. They do such under the illusion of an official capacity that no longer exists. In addition to powers and abilities "government" also has limits and disabilities. When governmental officials step outside of their official powers they are no longer acting in an official capacity. It becomes an individual capacity. It is easy to be confused. Violations of this sort are commonly referred to as "color of law violations" and they occur more frequently than most people know. A google search under that term, color of law, will turn up the relevant sections of the United States Code.

What I find most disturbing in the article is this:

"The oldest incident in the charges dates to 1999, his first year as a circuit judge. The first public claim against Thomas surfaced in lawsuits filed by an inmate in 2001 in Mobile circuit court and in federal court that claimed the judge offered to help him with his case in return for sex. Both lawsuits were dismissed, and Thomas' reputation remained unblemished."

I don't assume that the man is guilty. Our system is supposed to work with a presumption of innocence. If he is guilty the amount of cover up and complicity is quite staggering. How many people would it require to look the other way and to fail in the execution of their official duties?

Such may be the status of our judiciary.
