I wouldn't do it for everyone, but for you, I could definitely make an exception. How much money do you need to send me every month in order to get under the limit? If you're looking at a chapter 7, there are 3 different ways to qualify on the income part of it. The easiest way is the means test and it sounds like that is what he is talking about. If you're close on the means test (which I would take him at his word), then document the crap out of everythin you spend your money on. Collect all your monthly bills for utilities, medicines, doctors, food, gas, cell phone, cable, internet, etc. EVERYTHING. If you're looking at a chapter 13, then it comes down to how much you can afford to pay your creditors and documenting everything is just as important. When they prepare a petition for bankruptcy, it will include a budget and this information will be extremely important if your attorney needs to justify expenses that are greater than the status quo. Things like "I'm a diabetic" or "I have chronic......" or whatever plays a big role as those add to your living expenses beyond what a healthy persn has to pay. I started throwing it all in a folder. If I do this it will be a 13, not a 7. When ever I think I balanced a budget then I find a missed item. Somehow things always cost more then I plan. So far the papers have been easy to find. I do not know how much I have to use up. I had not thought of it. In way- there might be no point in a 13 if next year - if I am upside down in the house. Being upside down is not too hard to do right now. Perhaps I could stretch the budget further. Who knows.
