AFAIK, a JP is not permitted to deny a marriage license of both parties are of age and willing to marry.  The situation is no different than a government official denying food stanps or a library card or any other government service based on race.

I disagree that he should resign.  I'd fire him.

Sounds like a lame excuse to me...

While it is true that children are ostracized from each race, this is not a justifiable nor legal reason to deny the right to marry

JPs don't have to do weddings; it's a power they have to do them, and some of them don't do any.

Having said that, I would be ashamed if mine behaved like this character.

That may or may not be true if the reason had been "I only marry couples who both live in my parish" or "I only marry couples where both have a high school degree" or some such reason.

But race (and a few other protected grounds) is special; you can't make decisions based on race - even less when you are a government official. I suspect that the couple may well have reason for a civil rights lawsuit.

Few things surprise me anymore and this doesn't either. It's ridiculous and sad and he does not deserve to hold an office if he discriminates against some of the people there, but it's really not very surprising.

Status: offline 		This is 2009, not 1959. In the 70's, I was a child in the military and remembered one family whose kids were ostracized because of their mixed races. Today, there are more couples having children of mixed races and this does not bother me.

This will make me wonder of the State of Louisiana will fire this JP. I will even bet the American Civil Liberties Union might get involved in this case. Oh yeah, Mr. JP should also research the Loving v. Virginia case back in 1967, which forced the State of Virginia to strike the Miscegenation Code Statutes from the Racial Integrity Act of 1924. United States Supreme Court Justices ruled this code was unconstitutional. The vote was 9-0 for their dissenting opinions. Ironically, the ACLU was also involved with this case, too.

I totally agree, Steven. I always have to wonder where people live where such extreme prejudice goes on. Twenty years ago, sure, but these days interracial couples are not a strange or rare occurance. Hell, I'm from WV, now live in AR, and have lived in VA, TN, NC and KY. I've never seen or been personally involved in any such ostracizing over racially-mixed couples.

And as for the bullshit line about worrying for "the children," that doesn't hold water. Again, 25 years ago, maybe it wasn't as common to see children of more than one race in most areas. These days, again, it's not a rare occurance. I don't think it's a major problem across the US that mixed-race children are targets of hate. Hell, if not for adults, kids wouldn't even know they were "supposed" to be only one race. I "worry" for the mixed-race children too but only because of assholish, moronic adults who see that there is any kind of problem with their racial makeup.

This guy is a real gem. He won't marry two folks of different races simply because of that but two people of any race (as long as it's the same one) can walk in and NO MATTER HOW poorly matched they are, he has no way of knowing and marries them any way. Yeah, a real genius...................luci

Status: offline 		That JP has his facts skewed....it isn't just mixed marriages that don't last long, one out of two marriages in the US fail.  That's the divorce rate regardless of race.  Whites marrying whites, black marrying blacks, whites marrying blacks, asians marrying mexicans.....race has absolutely nothing to do with the divorce rate.  It's all the same across the board.
 
It sure looks to me like someone has a law suit on their hands.  Unless what a few have said on here about a JP being able to decline performing a marriage regardless of who asks.....
 
However, giving this another thought, he declined to do the marriage based ON THEIR RACE.  That's discrimination, no matter how you look at it.  If he's found to have done other marriages, and just not performed this one, he and his boss AND the county he works for, are up for trouble.
