My girlfriend and I have been living together for one year as of March 12. According to Canadian Law we are now considered common law husband and wife both for all intents and purposes of the Family Law Act and for taxation purposes. I guess I better watch My step now eh? lol [:D]

Thank you very much. We are doing well now, although for about two months I thought for sure we were going to split up. The Act gives her only a limited claim after one year. She has full protection of the Act after three. Since we have moved, although she has been very stressed as have I, she has been much happier and things have started to smooth out substantially. I see no reason why we will not make it to three and beyond at this rate. I want a prenup though, just in case!! haha

I'm not sure I like the common-law thing. Personally I don't like the idea that the law gets to decide I'm married without my permission...but that's just my opinion.

I'm glad things are going well for you!! Sounds llike you survived the move!!

Last I heard, thirteen US States still allowed for common law marriages. I just can not remember off the top of My head which ones they were.

First of all, congrats to you. I wish you both the best for the future.

Pennsylvania would be one of those states that still allows common law marriages. I believe that it is a period of seven years has to pass before it is common law.

Get the pre-nup... I know it sound terrible but it can help protect you if things fall apart. If I ever get married again (very doubtful but I won't rule it out) a pre-nup will be in place before I get anywhere near to saying, "I do." But as you know... I am a jaded SOB [;)]

Indiana is 7 years also...though, if you live with someone, and can show that you are the main supporter...then you can claim them on taxes and on insurance...it's a bit harder to prove with an adult...but if children are involved...it can be done...without being married, and within 6 months.

I don't know if it's still true, but such laws rarely get repealed. However, when I was at university in Rhode Island, we were warned by the Provost if we wanted to sew a little wild oats to stay south of the state border as there is a law in Massachusetts, that if a man and a woman register in a hotel as man and wife, they are married.

There had been a few occasions where ladies of less than perfect virtue and lured horny students into doing the naughty naughty over in Attleboro and then threatened to file for a common law certificate unless their "palms were crossed with silver."

Evidently, the university's president had gotten called on the carpet by parents and the delegated the poor provost to encorporate this bit of wisdom into his yearly "introduction to URI" speech.
