SHERRY JACKSON has been moved to a new prison and is now MISSING!! Sherry Peel Jackson has been moved again and she has not been heard from for over two weeks. She disappeared one week before Christmas and her parents nor her husband and two beautiful children have heard from her. She is the ex-IRS agent in Aaron Russo's video America ~ Freedom to Fascism http://video.google.com/videoplay?docid=-1656880303867390173 a must see film which every living man, woman and child must see. Aaron Russo gave his life to produce this documentary. Sherry, a CPA, Certified Fraud Investigator, received a 4-year sentence for telling Americans the truth, although she broke no law. Please ask everyone to send her an encouraging note so that she knows she is not alone or forgotten. Let her know that this country is aware that she has been moved, thousands are still watching her situation closely and praying for her release. Anyone who has been in her situation cannot imagine how much good is accomplished by countless cards and letters. It does much more than just lift her spirits, which in itself is huge. It also lets the system know that she is well-known and many are watching closely to see that she is treated properly while in her federal cage, with two long years to go!

Thats not why she was convicted or why she is spending time in jail.

A four-count information charged Jackson, a former Internal Revenue
Service (“IRS”) agent, with willfully failing to make an income tax return for each
of the four years from 2000 through 2003, in violation of 26 U.S.C. § 7203. Each
count alleged Jackson had the obligation to make an income tax return “as required
by Title 26, United States Code, and by regulations made under the authority
thereof.” The information alleged Jackson had gross income in excess of (1)
$12,950 in 2000 (Count 1); (2) $13,400 in 2001 (Count 2); (3) $13,850 in 2002
(Count 3); and (4) $15,600 in 2003 (Count 4).
At trial, Jackson testified, inter alia, she did not file income tax returns for
those four years because, based on her research of the revenue code and
regulations, she did not believe she was required to do so. The jury convicted
Jackson on all counts. Counsel represented Jackson at trial, but, prior to
sentencing, Jackson discharged her attorney and elected to proceed pro se.

This is what MOST people get convicted with. IF you wish to fight this law, you better do so while filing your taxes. Seems even the Supreme Court, despite someone else deciding it doesnt have the right, will dismiss the argument of the admendment being invalid.

I dont know the circumstances behind her arguments or the case just because someone feels they are not obligated does not mean they are in fact not obligated.

However the information you get at the book store does not match the "record".


As far as common law is concerned, ANY case heard before any court is still subject to appeal at the level of the Supreme Court.

The common law system allows for appeal under the rules of common law, which means that the Supreme Court is the highest court in the land. Any decision rendered by any court can be overturned by a court of appeals if the case does not meet all the standards of common law.




Ok so how does that tie in with this?

U.S. Constitution: Seventh Amendment

In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.

I recall her in a vid.

I dont know much about her personal situation.

The govt tho tends to fry people that draw attention to themself.  She was a former IRS employee- and drew attention to herself.

So jail is not a complete shock.

as to the quest to not pay taxes- IMO one can take an easier path- write offs-etc.   Note the many in congress and in the govt dont pay taxes.  So who is to say.

I do not give legal advice ever never.... (its against the law ;)

I am saying the 16th is not constitutional in as much as the dejure organic constitution is concerned that is correctl  Neither is the 14th btw but that might be another thread some day.

Bob Chapman says that the % who do not file is actually quite high.

I tho- have always filed.

If I thought that you would correct think me looney!  They are all in bed together under the APA....

They are legislated administrative courts....not common law courts....

They can proceed according to the common law as a legislated court.

You will not find the old days common law courts any more and you have to know how to create it in court and exercise your rights.

They are powerless and have no jurisdiction unless you give it to them.

Go on Dunn and bradstreet they are all one big happy corporate business!  I think I brought that up in another thread on here somewhere....



Oh to answer your question they can if you or someone you gave power of attorney too agreed that you will pay taxes...  like some agreement you made or a representative that maybe you gave power of attorney too made on your behalf....

That is actually the entire point of the Amendment. Assuming that it was properly ratified, then yes - they can.

That is actually the entire point of the Amendment. Assuming that it was properly ratified, then yes - they can.


It actually doesn't matter in the first place if it was ratified or not.

The 16th Amendment was only implemented as a precaution to prevent lengthy litigation. At the time, the legal consensus was that even without it, a Federal income tax would be constitutional - but rather than wait ten years for SCOTUS to resolve the case (and potentially having to refund huge amounts of money if SCOTUS didn't agree), Congress decided to use a Constitutional Amendment to clarify the matter.

If the 16th gave them the authority...then how does article 1 section 8 and 9 fit into the scheme of things?

Oh yeh and it was a result of the decision of the brushaber case where the court said the 16th conferred no new taxing power.
(I am quoting that out of my memory so bear with any minor inaccuracies)

The only way the supreme court can be overturned in "govenment" is by congress.

You do understand that the purpose of an Amendment is to modify the Constitution? That the 16th Amendment supersedes anything prior to it? So the 16th Amendment would take precedence over Article 1, Section 8 & Section 9.

Specifically the 16th Amendment:

"The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration."

replaces this section in Article 1, Section 9:

"No capitation, or other direct, Tax shall be laid, unless in Proportion to the Census or Enumeration herein before directed to be taken."

Maybe I'm missing something here. What's the sticking point?
