I guess this guy thinks he’s funny. Obama Launches YouTube Forum on Legalizing Marijuana Posted in Chronicle Blog by Scott Morgan on Thu, 01/28/2010 - 11:25pm Once again, the President wants to know what you think about marijuana policy. I'm pretty sure the forum isn't intended to discuss marijuana legalization exclusively. But you'd almost think it was, considering how many people have questions for the President about why our marijuana laws haven't been fixed yet. OK, want a question and the topic is pot ? Mr. President, when they initiated prohibition decades ago, why was it a Constitutional amendment and not accomplished by legislation or even executive order ? Ken could probably field that one better than anyone in government today, but I don't think even he will be in here with any bright answers. Why an amendment ? The answer is simple to a simplton like me, but I am sure someone more well versed in legalese could give a much more winded answer, so I will yield the floor. T

T The 18th amendment was the result of a movement not dissimiliar to the anti abortion movement of today. The movement's leaders felt that simply banning the manufacture, sale and transport of alcohol across state lines was insufficient so a federal law was out. As they also didn't want people simply crossing state lines they also ruled out piece meal prohibition laws in the states. So the only way to give the federal government the power to ban alcohol production etc. nation wide was by constitutional amendment. An interesting thing about prohibition as it relates to hemp, the Volstead Act, which implemented the ban set forth in the 18th, allowed production of alcohol for industrial purposes. Compare that to hemp where the intent seems to have been to go after the industrial uses by a very wide ban.
