Sen. Richard Shelby (R-AL) has put an extraordinary "blanket hold" on at least 70 nominations President Obama has sent to the Senate, CongressDaily (sub. req.) reports. The hold means no nominations can move forward unless Senate Democrats can secure a 60-member cloture vote to break it, or until Shelby lifts the hold.

Wasn't this the exact same tactic under the last President? Both sides seem to enjoy this tactic now that it has been introduced as precedent. Oh, and until just a couple weeks ago, didn't the Dems have the votes to move nominees passed a filibuster?

I increasingly would like to see the filibuster go. I used to be on the fence about it. But in the past few decades, both parties are simply abusing it.

I dont  like filibusters who ever is doing it, to me its more childish that poking out your tongue and singing neener.
Im also aware that  both sides do it.
In canada, all three parties do it.
Politicians are worse than cranky three year olds.
The fact that one man is doing it, "just because" it isnt a republican idea tells me that he needs a fucking good hiding and some time out.

Indeed, it has been being abused. It does still have merits though. One being, that the majority (should) needs to compromise with the minority to get major legislation passed in the Senate, theoretically leading to better legislation.

I don't think the filibuster should be allowed to be used for nominees. I didn't like it under the last administration, and I don't like it under this one. I believe that the President should be allowed to surround himself (herself) with the folks they trust to be best for the job. It allows them to rise or fall based on their own merits and judgements.


That being said, I am also sick of the victim mentality of the majority, especially recently. The whole "I couldn't do it because the other side was loud and outspoken" thing bugs the shit out of me. Elected folks need to start taking responsibility for their votes or lack of them, and the people need to start holding these folks accountable.

Our current President was guilty of the very same thing during the Bush administration. Not that such behaviour justifies the current behaviour. Karma is a bitch, sometimes.

Obama can blame, piss, moan, yell, or do any fucking thing he wishes, but the fact is that his legislative 'dick' has been chopped off.... the seating of Scott Brown now ends his ability to ram ANYTHING thru the congress, and now we will simply wait for the mid term elections to bring the tidal wave of sweeping the libs out of power.... the 'progressives' (see communist) have blown it with the nation and its OVER for the Obama administration.... like Carter he will be a lame duck historical footnote,  as of next November and the nation is about to undergo change like it has never imagined in eons.....  A new rebirth of LIBERTY will sweep over the land like a tidal wave and government will be cut, slashed, and diminished like a bull is neutered..... massive government layoffs, programs and agencies defunded, and whole departments like energy and education, the EPA, and many many more will be ended PERMINATELY...... you and others will sit back in awe as the people are FED FUCKING UP with a government class laying on its collective ass, with  huge salaries, benefits and perks will be FIRED..... and run the fuck out of town..... this nation is about to feel the effects of an explosion of liberty and individual freedoms like we have not witnessed since before the great wars..... its time to roll up  your sleeves, get to work, and LEAVE PEOPLE ALONE.... we don't and won't hear your moaning, your crying, or your screaming racism at everything....we don't CARE what you think....we don't care how  you see the changes....either like it, or LEAVE......  and we have guns if you wish to try to change it...... its time for this Republic to be the free nation it was always intended to be....either we learn to live with each other, or we have internal civil war, but either way, the Obama idiots are DONE..... he is a lame duck, soon to be added to the column of failed, marxist pukes that tried to force their big government crap down a nation's throat that is weary of big government anything.....its over..... and hide and watch this wave rising to wash this socialist crap out to sea...... and those that drag their feet with it....

From my understanding, the longest filibuster was by Thurmond (such a pillar of virtue! but thats not the point) against the Civil Rights Act of 1957

Filibuster and Cloture


19th Century Filibuster

Using the filibuster to delay or block legislative action has a long history. The term filibuster -- from a Dutch word meaning "pirate" -- became popular in the 1850s, when it was applied to efforts to hold the Senate floor in order to prevent a vote on a bill.

In the early years of Congress, representatives as well as senators could filibuster. As the House of Representatives grew in numbers, however, revisions to the House rules limited debate. In the smaller Senate, unlimited debate continued on the grounds that any senator should have the right to speak as long as necessary on any issue.

In 1841, when the Democratic minority hoped to block a bank bill promoted by Kentucky Senator Henry Clay, he threatened to change Senate rules to allow the majority to close debate. Missouri Senator Thomas Hart Benton rebuked Clay for trying to stifle the Senate's right to unlimited debate.

Three quarters of a century later, in 1917, senators adopted a rule (Rule 22), at the urging of President Woodrow Wilson, that allowed the Senate to end a debate with a two-thirds majority vote, a device known as "cloture." The new Senate rule was first put to the test in 1919, when the Senate invoked cloture to end a filibuster against the Treaty of Versailles. Even with the new cloture rule, filibusters remained an effective means to block legislation, since a two-thirds vote is difficult to obtain. Over the next five decades, the Senate occasionally tried to invoke cloture, but usually failed to gain the necessary two-thirds vote. Filibusters were particularly useful to Southern senators who sought to block civil rights legislation, including anti-lynching legislation, until cloture was invoked after a 57 day filibuster against the Civil Right Act of 1964. In 1975, the Senate reduced the number of votes required for cloture from two-thirds to three-fifths, or 60 of the current one hundred senators.

Many Americans are familiar with the filibuster conducted by Jimmy Stewart, playing Senator Jefferson Smith in Frank Capra's film Mr. Smith Goes to Washington, but there have been some famous filibusters in the real-life Senate as well. During the 1930s, Senator Huey P. Long effectively used the filibuster against bills that he thought favored the rich over the poor. The Louisiana senator frustrated his colleagues while entertaining spectators with his recitations of Shakespeare and his reading of recipes for "pot-likkers." Long once held the Senate floor for 15 hours. The record for the longest individual speech goes to South Carolina's J. Strom Thurmond who filibustered for 24 hours and 18 minutes against the Civil Rights Act of 1957.

Which essentially meant that the Democrats in the Senate had to vote as a unified block on every issue.

Yeah, that's why I've always been on the fence about it. The theory is decent, even if the practice has been abysmal.

I like your point about nominees, though (except perhaps judicial nominees, especially the Supreme Court). We have hundreds of vacant positions over this bullshit (and have had in previous administrations too). Often it has nothing to do with the nominee, but with a Senator who wants to make an issue about X.

Vote 'em up or down and move on.

No it won't. The people on this forum are ample proof of that. There won't be any change at all unless conservatives regain control of the House and end up with a 64-65 conservatives in the senate. Over 60 because once the Republicans are back in power, the RINOS will go back to working with Democrats for their personal political gain. I'd give my left nut to see JD Hayworth beat McCain in the primary.

There are democrats that are far more conservative than republicans, moderate democrats and whacko leftwingers.

Kennedy couldnt make every vote, and Liebernmann is far right of Strom Thurmond on most issues.

Bullshit back at ya. Between Norm Colman's frivolous lawsuits delayng Senator Franken's seating and Ted Kennedy's illness and subsequent death, the Democrats had an actual caucus of 60 - physically present and able to vote - for a tiny fraction of the session.
