I just got a notice that they are cancelling my house insurance as of March 19th. The reason is the sidewalk is uneven. I don't know if I screwed up, I told the agency to find me another company but my sister made the original deal and did not tell me that the agency was no longer indepenent. Oops but so what.

The problem here is what do they expect me to do, pour cement in 20 degree weather ? Are they crazy ? This is a typical case of their bullshit, what they want is to just collect premiums and never pay anything out in claims. It always was and is a never ending battle.

What's more I'll not be dictated to, so technically if the want to cover me for everything but personal injury liability I can deal with that, as long as they price it right. But shit, this is still ridiculous. I don't even shovel my sidewalk, making injuries an act of God when the snow flies. What's more tchnically the tree is causing the sidewalk problem and I think that should be considered an act of God.

You know what I might just do, turn the fucking tables real quick and put in a claim. See the main drain out to the street needs to be replaced this year. The tree roots has caused the collapse of the old clay pipes under the front yard.

Don't forget they are fucking with a terminator here. If they deny the claim because it is an act of God, then they sidewalk is an act of God. If they do not insure against acts of God then they have no basis to quit insuring me. This is defined under Ohio law as redlining and is illegal and highly sanctioned. And I know how to use the law.

So the insurance is in effect now. In writing I have their reason for cancellation which contradicts logic due to the fact that act of God are a clear exclusion in the contract. They are really fucking with the wrong dude here.

At this point in time I have a partial plan of action, and I would prefer not to go ininsured. But any pointers, advice or whatever ? In our merry little group here I am sure a few have had to tango with these people.

Thing is, if I make the move it must be before March 19th. I know they are in business to make money, but too much is too much.

Moreover I am not putting in a new sidewalk now even if I could because it will just get torn up to replace the drain/sewer pipe out front. Is it like I am required to be stupid here or something ?

This place is paid off and I could ride bareback if I want, that is no insurance. And really I am not going to go crying to them if someone hijacks one of my laptops or something out the front door. I like to have insurance because some things are bigger than me. Like a fire or something. Others put in a claim when their TV breaks claiming lightning hit the power line or some shit. I don't do that.

From what I understand from my sister there is another company who came in with slightly lowere limits and a higher deductible, like a grand. So what ? I am not going to bother them for a grand. But if I am going to have the same bullshit with them, why ?

Company in question now is Nationwide. I don't know who the other one was.

See how when you ask for anything they always want something ? I have to fix the sidewalk twice ? Bullshit. If they believe they can be subrogated by someone tripping on my sidewalk which is clearly an act of God, then the destruction of my drain is an act of God and therefore covered.

And all of you who think I am full of shit about the law and all that, I might just be able to come up with some court transcripts this time. Which is it, excluded or not ? If excluded I have been discriminated against. If not excluded I should get them to pay for about ten grand worth of work to fix the pipe. Or is it whatever they say goes at any given moment and written contracts mean nothing ?

You fucking bet I am going to find out.

How are you getting redlined?  Do you think that you're the only one with uneven sidewalks that gets canceled?

In the meantime, get the parts that stick up (that form trip hazards) ground down - they do that on the older sidewalks at work.  Then wait until the pipe's done to replace the sidewalk.

I would call my insurance agent, if I were you.  A few years ago (before we got cancelled because we live in FL lol) we got a letter from State Farm saying they were cancelling us for a shed that had been demolished in a hurricane.  It actually wasn't demolished, but it got crumpled.  We were still using it for some yard supplies.  All it took was taking it down and covering the contents with a tarp and the problem went away.  I would call your agent and find out what brought them to that determination and what you could do to fix it.  (cuz our agent suggested covering the stuff in it with a tarp)

Insurance companies suck ass. We are in litigation over a car wreck atm. Whatever the case thornhappy has a point. If your inclined to do so I am betting there is a Class Action opportunity here.

Not sure a pro bono would take it, they are getting remarkably bad about taking cases (We suffered a clear violation of the ADA law that no one, and I mean NO ONE will touch.) You sound like a well educated Pro Per litigant or you have legal training so I'm betting that you would be able to instigate a Class Action by yourself. Looking forward to hearing more about this one.

If you are really so sure you suffered a violation of the ADA law, you can contact the State Prosecutor's office, since they prosecute on that. Further it could be taken under a personal injury type of action which is contingency, so your "clear violation" might not be as clear as you think.

The OP could not instigate a class action by himself, as he can't represent others which to certify something as class action is necessary. Then again, the OP seems to think that not shoveling his walk frees him from liability should someone fall and get injured. I wouldn't recommend you hold your breath waiting for this to have an outcome in his favor.

I like the "act of god" angle you mentioned....lol....good one to throw in their face!

Check with your state's insurance regulator to find out if their demand is within their rights. Uneven sidewalks usually have repairs governed and mandated by the local municipality. These days it is a slightly higher priority due to Federal ADA Regulations, in maintaining a level grade for wheelchair access.

FR UPDATE

Before I got home from work today Woman says they called. She said they were amazingly friendly and said that everyone in the office was working to resolve my "problem". You bet I bet they know they fucked up. What's more she said they said that the gravel driveway is the problem, it is in need of gravel. What's there is pounded down pretty solid and I almost like it that way, but for fory bucks worth of gravel I can fix this.

The sidewalk issue is a different thing I guess and that is not what they were talking about, but now they have my attention. If I call you friend I will die for you, but these clowns are in season.

But given this countermove it is alot harder. Doesn't mean it's impossible though. It's at least as possible as keeping a gravel driveway level with the sidewalk. Like I said, this indicates that they know they fucked up. I have significant emotional trauma (is there a smiley of one sticking a finger down it's throat ?).

No move today though. I have plenty of time to decide what to do. I might opt out, get some gravel and STFU. But now that they started this shit, it might just be me who ends it. March 19 is the cutoff so whatever I do must be done in a couple of weeks. Well the agency is getting me an "extension". If they think that is good enough they are sadly mistaken.

Term- when anyone starts complaining about my sidewalk- I tell them I am thinking of removing it.   (as in no sidewalk anymore)  It has a punch because for some reason across the street one was never built.   lol.

Hunky, I am reminded of this old ratty POS screen door on the front here. The city inspectors mentioned it and my response was to just tear it off. I did it withg my bare hands :-) and scrappers came by later for the aluminum.

But in this case the issue is the driveway, and at this point I am considering the possibility that they are trying to diffuse what could be a possible problem.

The original notice said "driveway or sidewalk", why didn't they specify at the time ? Why did the letter include information about Ohio Fair Plan, which gets people insured when they are supposedly uninsurable. They wanted to get rid of me, and that is an indication of redlining. If I can make a good enough case to prove it the sanctions would probably be onerous. I think they know it.

Really, even though my personal problem seems to be rectified now, I still smell an opportuntity. I have passed up way too many in life. Even some hush money would be nice.

I will se which way the wind blows first, but I think it a good sign that the owner of the agency called my house.

The wheels are turning. Really I am not that bad of a person, but at least half of the people here would cheer me if I  stuck it to them. I need to think this out. If I start some shit I will have to get another insurance company for sure, but that shouldn't be a big problem. I mean these people were talking as if the "problem" would not or could not be corrected. The whole tone of the notice was to get me to find someone else.

If you go the gravel route, try this.....get yourself a load of pea-gravel with a good amount of lime powder mixed in. This will be easy to level out. Once you do that, wet it down good with water (soak it but don't flood it). Let it dry for at least a full day, two days if you can. This will set up almost as durable as concrete then. It will be years before you need to even think about doing it again.

Thats because the sidewalk isn't his responsibility. Its legally considered city property. Its maintainence is the responsibility of the city. If someone falls and injures themselves they can sue the city, not the person who's house borders it.
