There are strange laws about branding.
The act of branding is illegal but once done it is legal.
Its another spaghetti law that police really don't want to get involved in and your link shows why. Lots of body mods give and receive brands and openly display and talk about them on sites like BME. Some tat shops even run links to their branding departments in an effort to have the monopoly and make more money.
My partner is a professional brander. I say professional because he gets paid for it. He puts the same rules around branding as a tattoos, piercings and skin removal.
