In a way- I am sort of surprised this has ramped up in PA.   Oh well.  Stuff happens.

I actually had a dept passed on to one of those companies last summer, for a crappy $84 bucks that I didn't pay just because I put it off, and off again...had the money and intended to go there (it was like a 10 min walk) lol but never did. Really for what he must have been paid, it surely wasn't worth him calling me for weeks.

So this guy was calling me DAILY. He got meaner and meaner lol. More and more intrusive, questioning, 'when? howww? can you pay, did you go to the bank yet??? we won't take it direct to the company now--YOU MUST pay at the bank!!' kinda thing. lol

Some days I actually looked forward to him callin'....I was actually gettin' off on it LOL..I love caller ID.

I'm fucking SICK [:(]

This is why you screen calls with an answering machine. And why we have call blocking.

I wonder how they would take it if you told them harassment turned you on,and you enjoyed the free entertainment..and were not ABOUT to pay as long as it went on?

Someone gotta pay those people back...somehow. [;)] it was a errr uh duty as a good citizen.

My friend told any collector who called when she was in massive debt from her divorce that she is recording the call and stated the date and time.  (she actually never recorded a call that i know of lol but she said they don't know that).  She also told them that she kept a list of how many times they called her in a day as she knows the law states that they are only allowed to call her one time a day.

They always objected and she stateed she will continue to record their conversation and if it came to a court hearing, she will let the judge determine if the recorded calls are relevant to the case.   They never seem to want to talk to her after she stated all of this.     She said you are more than welcome to send me anything in writing if you don't like the fact i am recording this call.   They usually ended up hanging up.  

Also, you can state clearly to any debt collector that they are not allowed to call you at work nor are they allowed to call any other people regarding your business issue.   Also put this in writing and send it to the company, keeping a copy for your file.

She said when she was in debt this worked wonders.

They do what they want to do.   Some of these calls come in via VOIP computer from India.  So- unlikely anyone would be sued.

Yes, there is a timeframe and a limit to how many calls they can make in a day/week legally.

side note: in Canada there is a govt call number to have your name removed from the telemarketting lists. If you register, and If you still get a call, that company can be fined. Yet, it does not include calls regarding a debt owed.

PaHunkboy, the US company that they are calling from is the company that is liable and can be sued for harassment. But more so the recording of the call comes into play when or if the company takes you into court for a judgment or garnishment. A company cannot harass you, so they would be very careful in taking people to court if they are harassing them and believe the person has proof of said harassment -- i.e., recorded calls, proof of continuous calling per day, threats, harassment. And harrassment of debt collectors can come into play if a person is sued for a judgment by a company. I am not sure if you are speaking of debt collecting company's or telemarketers. In the US you put your numbers on DO NOT CALL registry and make a complaint if you are called for telemarkets


Your thinking that no one will ever be sued and acceptance of same is why these company's believe they can do what they do. If you start fighting back and turning the tables against them, things change. The problem is when people make excuses about why nothing can or is being done and just sit back and not be proactive.

The best way is to pay the bills, but sometimes people can't do that for whatever reason. That doesn't mean they have a right to harass you and threaten you and make you sick etc.

Justa quick note about the "no call list" in Canada & the US...it does NOT apply to market research, so survey takers are free to call...however they are required to remove your number from their call lists if you request it...but you have to specifically request it.
