In Walmarts world it's all about control & profit.

WalMart Fires Associate Of Year, Cancer Patient For Medical Marijuana

Despite medical marijuana being legal in Michigan, WalMart has fired a cancer patient and former employee of the year who tested positive for the drug, which was recommended by his doctor.

Is medical marijuana legal in Michigan?  If so, an interesting legal question because the employee would be in full compliance with all state law while breaking federal laws.  If not, slam dunk for Wal-Mart.

Navina -> RE: WalMart Fires Associate Of Year, Cancer Patient For Medical Marijuana (3/12/2010 9:36:39 PM)

It sucks that they did this, even though medical marijuana is indeed legal in Michigan. However, since Michigan is an at-will state (Montana is the only one that isn't), they did have the legal right to end the man's employment. I hope he's able to come out of this alright. Walmart is a deplorable company.

It is legal in Michigan. The employee in question had a medical marijuana card.

This is not anything new.  I don't know of any state right now where you have protection from being fired for a failed drug test even if medicinal marijuana is legal.  It's not right but nobody has moved to change it.

Well of course it's right.
Let's start with truck drivers with prescriptions for pain meds and dope.

Good for Walmart, Dope is for dopes.

The fired employee should go to the garden department, pull up a lawn chair, and fire one up.

Seriously, they shouldn't have fired them.

So you are comparing the driver of a semi to the walmart employee?

the worst thing that might happen to the medical marijuana using walmart employee is that he might binge on some pringles.

Now let's talk about driving a semi that can weigh in excess of 30,000 lbs when empty. What is the worst case scenario there?

Do you know servant4use? You guys could be brothers. Who hurt you?

Sacramento, September 30, 2008 - Governor Schwarzenegger vetoed Assemblyman Mark Leno's bill to protect workers' right to use medical marijuana.
The bill, AB 2279, would have made it illegal for employers to discriminate against workers in non-safety-sensitive jobs for using marijuana as medicine. In his veto message, the governor said "I am concerned with interference in employment decisions as they relate to marijuana use. Employment protection was not a goal of the initiative as passed by voters in 1996."
Prop. 215 sponsors disagree. "The intent of 215 was to treat marijuana like other legal pharmaceutical drugs," says Prop 215 co-author Dale Gieringer of California NORML.

AB 2279 was intended to overturn a Cal. Supreme Court ruling, Ross v RagingWire, that found that 215 did not protect workers against arbitrary discrimination by drug urine testing. Employers failed to present any evidence that off-the-job marijuana use presented any safety risks.

Gov. Schwarzenegger, a former recreational pot smoker, has vetoed every marijuana reform bill that has come to his desk...California NORML

Until we address drug laws at the federal level-this is going to be an ongoing cluster fuck.

Yes, let's just ignore that it was doctor-prescribed to ease the pain of cancer.

Anyone out there connecting federal law to the iran contra sort of thing?

Where the cia used sales of illegal drugs to fund "black ops?" so there was no need to account to congress for the funding to the contras in nicaragua? And got the stuff moved into the country on military transport planes to subvert customs?

Maybe legalizing the stuff and dropping prices is not in thier best overall interests?

Not to mention that it's not like the patient sits and smokes a joint. The idea is to take a few puffs off the joint and put it out. We aren't talking about someone getting completely stoned here, just using enough to kill the pain of his cancer.
