On Monday, the U.S. Supreme Court heard arguments in a case that questions whether a California city violated a public employee's rights by reading sexually explicit text messages on an electronic device owned by the Police Department. A decision has not been made.

Although the case involved a police officer, some legal experts said the ruling could have broad implications on how public and private employees can be monitored.

Wasn't already declared legal for employers to monitor emails on company computers? Isn't this the same thing?

Another example of the declining intelligence of our country, I see.

Wow....a workplace checking the texts you send on a WORK phone?!?!?! My gosh!!! I'm stunned.

how do folks have time to do this texting and surfing and playing games while they are at work? 

silly me, when i am at work, i have to.....well.....i have to do damn work....bout all the time i am there even.......

When you play with personal stuff on company time-you are a thief as far as they are concerned. You are stealing time they paid for. When I am at work-I work for my company. I want to support what pays MY bills. And every goldbrick on the floor weakens my ability to do that. It pisses me off no end.

About one in five companies that fail due so because of dishonest employees.

I heard someplace that Americans (that work, still have jobs) spend more time at work than any other industrialized country....maybe if some of these idiots could get off the phone and do their stupid job they wouldn't be there so long.

AND if someone is stupid enough to use company stuff with out knowing that the company can read emails and messages then they shouldn't even have a job

Imagine that, I guess we just get less and less perks every day. Didn't the assembly line stop at Ford motors for that one guy to take a joint break several times a day ? Aren't the commercials on a TV show brought on sponaneously when someone's twitter goes off ? Doesn't the cop giving you a ticket for texting while driving get a break in case one of his mistresses call him on the cell ? Doesn't the line at the grocery stop anymore when the bagger needs a beer ? Don't nuclear power plants go offline when someone has to call their kid in college ? Doesn't NORAD shut down when the floor sweeper has to take a shit (that could explain 9/11) ?

Land sakes, what is this country come to. We already go to work and now we are expected to produce ? The hell you say. Our great leader Clinton produced something every time he could, that is semen for Monica's mouth. At the same time he was polling the electorate. Multitasking, what a Man !

I remember reading about that case.  Part of what they are claiming is that the intimate texts he sent to his wife and his mistress infringe on his wife's privacy.  They are arguing that the police department doesn't have a right to know what's being done with their own equipment.  Damn right they should!  After all, if it's being used for something illegal it can come back and bite them.  I'm behind employers all the way on this one.  You don't want them to know, don't do it on their equipment.

Yeah, I don't agree with constant surveilence anywhere, but if you want to take care of personal business, do it on your own time - and equipment.

I think people have a right to privacy and expecting employees to be working 100% of the time and not be able to talk to their spouse or children for a few minutes is unreasonable.

While I agree that employees should be able to be disciplined for using business property for personal use during working hours, I don't have quite the same... conviction as many here for condemning.

Any company I have ever worked for that provided a cell phone to an employee, did so because they expected that employee to be able to be reached at any hour of the day, any day of the week... including the employee's personal time away from work.

Those companies also had policy guidelines about how the phone could be used and all allowed some personal use so long as it was not excessive and did not interfere with regular business hours.

I'm not sure companies need access to the actual content of text messages.  They do already (through their phone provider) have access to the number of text messages, to the telephone numbers of the parties involved, and to the times the messages were sent and received.  It would seem to me that would be enough to determine if an employee was abusing any personal use of company property.  To have access to the actual messages would appear to violate the privacy rights of the other parties involved.

Of course, I don't have to worry about that any more.  I can use my business phone for any darn thing I want... even send the most sexually explicit messages to my boss.

If any company wanted to be able to contact me 24/7 they better be paying damn fucking good. Also that SOB phone better have four batteries, two car chargers, two house chargers and unlimited worldwide minutes, all 43,200 of them each and every month. If they want me like that, and don't meet my requirements they can take that phone and do their very best to make sure it does not get sunburned.*

But when I am getting paid I'll carry any communication device they need me to carry. My buddy, about to hit the road as a towtruck driver. When he goes to work he is going to turn in his phone and carry the company phone. I think that is reasonable. Understand that I have been in business and I am aware of the cost of "stolen time". I am now more of an employee, and I sell my time. I sold all of it between this time and that time. Any time I am not working directly towards the best interest of that company I am polluting my product. You really have to be an idiot to do that.

Now other jobs are different. Some are paid to be on call, or waiting for a call. In that case well, local law applies. Maybe they can go do their nails or jack off or whatever certain times. Fine, but I would consider being paid for what is actually off time a perk.

At least that's the way I see it.

In the United States, it is madatory for employers to provide regular breaks for the employees.  I didn't realize Canadian employers were such slavedrivers.    I get 2 mandated breaks of 15 minutes each (and get paid for that time) and then a 30 minute lunch break (for which I do not get paid).  There is plenty of time on breaks to talk to spouse, children, lover, or pizza delivery.  I do not need to use the company's equipment.  They own it, not me.  If you can't take care of personal business in an hour each day on your own damn phone, you need to find a way to live on part-time wages.

I like to text when standing in line- or waiting in a DR office.

I am- not real keen on others overhearing conversations... so text is nice.

Actually, no.  Not even meal breaks.

Some states do require breaks, though not many.

Aye. However the issue is not can they talk to their families but that they can be monitored while doing it. That being the case, why not someone just use their own personal cell phone for such occasions?

I disagree with this entirely. I'll tell you for why - this isn't about time for me. People are individuals, we all work differently. Some people can do certain things quickly, almost without thinking. Other people need a bit more time to focus, prepare, they pay more attention to details.

To me the issue which is more important to me as an employer or boss is attention. I need the attention of anyone working for me focussed on what I am expecting them to do. If I applied the principle you gave above this would not guarantee me the attention that I need to ensure the job gets done properly. I would have perhaps a majority of people giving their attention, and a minority perhaps going through the motions because they are thinking about something outside the sphere of work. This to me is - as an employer or boss - unacceptable.

Therefore if their personal use is going to lead to them giving their work their full attention then I say that's a good thing. I understand that the people who work for me have other commitments, such as a family and them spending time at work dealing with essential matters concerning their immediate family is perfectly acceptable. If they need to take time out to pay an important bill or go arrange a manner in some office or even go see a doctor I will always agree to this.

However if their personal use is devoted to hooking up with someone, posting on message boards, checking out Facebook fifty times a day, this suggests that they'd rather be somewhere else and I can arrange that too - permanently.

I don't know much about business, but this much I do know - business isn't so much about money, it's about people. When you invest in people, they will invest in you, and those that don't just don't matter.

This is in my opinion perhaps the most common reason for businesses failing - their failure to wisely invest in people.
