Haha theoretically no, but those are also some of the poorest people out there that I know....for the amount of hours they put in when they are in session, the pay is horrible....so they probably are using government funds to pay for their sex services! [;)] I think the law envisions LEGITIMATE government funds, so you're safe! (mostly)

No, it's not the same as hiring for employment.  Even without a nifty sign on display, every business is free to "refuse service to anyone"... even if they are government funded.  Someone who provides hands-on services are certainly free to refuse service to anyone they want.  Massage therapists, manicurists, etc. 

Sexual surrogate is a legitimate, legal profession, in which a person provides sexual therapy to a client.  The sexual surrogate is free to refuse to take on anyone as a client, for any reason.

Just don't put up a sign that says "Whites Only".

They are not the same in anyway. I guess you also feel that a prostitute must accept any john who wants to pay her for her services? A lawyer must accept any client that wants to "hire" (retain) them?

While this may or may not be a purely hypothetical question, it certainly lacks any kind of common sense. If people were to tell you that it was discrimination, would the next question be how to go about sueing the pro dom/sub for refusing to provide their services?

There are Federal laws about hiring and housing discrimination.  The law doesn't see you as having any rights  to beat someone's ass, or getting yours beat.

It's exactly the opposite.  Can Wal-mart demand that anyone they please come to work for them at their terms?  Hardly. I am a professional in something other than BDSM.  I am quite free to choose who I accept as a client, and can use any criteria I please.   Why should BDSM be any different?

I'm not a lawyer, but I suspect you may not deny service to anyone based on race or creed. This is basically impossible to enforce, becuase you can come up with any other reason you want (maybe you dont like their haircut?). But basically, businesses in the US arent allowed to descriminate. Starbucks cannot have a sign on their door saying "whites only" it's plainly illegal. I wonder where folks are getting information to the contrary?
