A couple of weeks ago i started a thread about my Mormon cousin who posts daily religious rants on facebook. ("this is my Mormon family"/ask a submissive) Basically i was just complaining because i think her constant preaching is annoying. But today i received an alarming message from her on Facebook. She claims to have a friend who was "banned" from Facebook for expressing his religious views against immorality and abortion. I don't know the specifics of the situation, only that the Facebook management permenently deactivated his account without giving a reason, but purportedly because he was expressing his religious views. If this is true, then i find it extremely upsetting. i don't agree with the politics of my cousin or her friend, but i would have thought that their speech and opinions on Facebook were protected by the First Amendment. i didn't know it was possible to "ban" people from Facebook. Can anyone shed any light on this subject? Does anyone else know of people who were banned from facebook for expressing religious views? i am very curious...

I dunno.  Most sites have a TOS, perhaps your cousin strayed outside the bounds.  Also, there is no pure "free speech", especially when you are at a place at the pleasure of the ownership.

Yes, he probably violated tos. I think this post should be under off topic or politics and religion though.

Free speach on facebook is not protected by the first amendment. Face book is a business venture. The free market protects us there, not the first amendment. The first amendment keeps the government from infringing on free speach Facebook is in no way supported by the government.

It is supported by advertising, and by users who view that advertising. When a business does something you find offensive, quit using them, and spread the word so that others who agree with you can join you. You don't need the government to protect you from businesses, you have that power all by yourself.

Sites like Facebook have Terms of Service (TOS) perhaps that was some how violated.

Here is a portion of that TOS agreement.

Protecting Other People's Rights

We respect other people's rights, and expect you to do the same.
1.You will not post content or take any action on Facebook that infringes or violates someone else's rights or otherwise violates the law.
2.We can remove any content or information you post on Facebook if we believe that it violates this Statement.

If enough people complained about being harassed... All depends on what this person was doing. IF they were posting on peoples walls and being a pain...

That said, facebook does not fall under free speech rules. Neither do most websites for that matter. Collarchat isn't free speech either - start posting about how much you love incest, bestiality, etc. and watch how quickly your posts go *poof*

My guess is that the person wasn't banned for solely expressing their religious views.
My guess is that he will see it that way BUT that somewhere within those religious views was some hate-speech that as others have mentioned violated FB's TOS.

May I ask what the religious views her friend was expressing were, pam? The Mormons have a bit of a rep for gay bashing, and that's considered offensive by a lot of people.

I have seen lots of stuff on fb and know of no one who was banned. Since we can not know exactly what happened I can only assume she went to far with her religious views and people complained.

I know, right?  It's like this one time my cousin's baby mama's caseworker's beautician was in Kroger, the one over on the west side of town, with the crazy dude in the parking lot who is always yelling out lines from King Lear in Spanish--but so then anyway this beautician was waiting to pay for a box of condoms and a loaf of bread and a copy of People with Sarah Palin on the cover and there was this Moslem woman ahead of her in line.  So the Moslem woman gets up to pay for her Jihad supplies or whatever, and she's like a buck fifty short.  And she's all freaking out but the beautician was like "Lady, chill, I got you covered."  So the woman was really grateful and she waited for the beautician outside and she looked at her and whispered "Something big is going to happen.  You have shown unto me a great kindness, Allah be praised.  So unto you I give the advice:  Do NOT drink Coca Cola products, under any circumstances, after June 1st.  Something big is going to happen, and I want to spare you and yours, because of your kindness, Allah be praised."  So she walked away and the beautician is standing there going "Holy shit."

So needless to say, ever since I heard this story, I've switched over to Dr Pepper products, although I do miss Surge Cola which is green and contains potassium (but you can't find that too many places these days anyway).  It is VERY IMPORTANT that you forward this to anyone you care about immediately because it could save their life.

i'm sorry, but i'm ignorant to the exact situation. i don't know exactly what was said. i don't even know the person who this supposedly happened to. i kind of just heard it through the grapevine, which, i know, is a pretty distorted way to receive information. i didn't realise there was such a thing as a TOS agreement. Now that i think about it, it makes sense. My cousin goes far enough with her fanaticism-- it even bothers me. Her friend probably went even farther. i still think that people should be allowed to express whatever views they have, no matter how stupid, but as many of you have pointed out, Facebook is a private enterprise, not a government agency, and i suppose they have the right to kick people out by whatever criteria that want.

i also realise there is no absolute freedom of speech. Still, can someone who understands this better than me explain it in detail? If Facebook can kick people off for expressing views that bother other people, then what prevents my job from doing the same thing? My friend knows someone who lost their job because of a Collarme profile. Can you be kicked off of Facebook for expressing views that go agains the Facebook TOS, when you're not even on Facebook. What if you're a skinhead or something (i am not defending skinheads) but you use Facebook purely to connect with your friends, without expressing your political views. Can you be kicked off if enough people complain that they know you're a Nazi? What about the other TOS rules? In my Facebook profile, it has a quote by Abraham Lincoln. i did not attribute it to him (there was not enough space), nor did i ask anyone for the permission to reproduce his words. Isn't that a violation of copywrite? Why wasn't i kicked off Facebook?

Under what circumstances is freedom of speech protected?

My suggestion is you go look up and read about fair use.
If you use something that belongs to someone else - then quote it.  As long as you don't try and claim it to be your own and there was no stipulation that it's not to be reproduced the worst they can do is have you remove it.

There is a difference between someone being a racist (I'm not even going to use your stereotype of a racist because that is just plain stupid IMO) and having a facebook page.

Of course the owner of the copyright could sue you.

It depends on the laws of your state, but in some states the answer is nothing at all. In many states, an employer can fire you for wearing a color they don't like.

Theoretically, but why would they want to? It's a privately owned website. They can boot you for having blue eyes if they want, but I can't think of any reason they would. They only care what you do while you're there.

Very few. A lot of people have the completely mistaken impression that it means everyone has the right to say whatever they want, anywhere they want, anytime they want, and nobody can object, but that could not possibly be further from the truth. All it means is that the government can not shut you up. Generally speaking, any private business  that you patronize can refuse to do business with you - ban you from their website, whatever - for any reason at all. And with some limited exceptions, there's absolutely nothing you can do about it - nor should there be.
