Yep.  And commercial leases are also very different from residential leasing.

The situation is that you had a signed lease with someone who is no longer there.  The paperwork around the original lease should contain some language about the lease getting assigned, and you need to read it. Hope fully, it said something about the tenant's ability to assign the lease being conditional upon landlord approval.

Think strongly about a restraining order.  He needs to threaten you first.... You can't get one just because you're afraid of him.  Call police NON-emergency number and tell him to leave.  I had a situation where police came - they themselves couldn't take key, but at their suggestion, I asked for key.  Person gave it up - after all, police were right there.  That's step #1 to your safety.

Screw the legal-get-a-lawyer method.  You are projecting what you would like to have happen to you if the tables were turned.  Is he on parole?  That is public info.  Contact parole officer and give his current location - might have broken parole already by not giving correct address.

What else to say?  GET SAFE!  Then you can start making some rational decisions.  Right now, you are in panic mode.  I learned long ago - panic buys you nothing.  Calm down.  Get safe.

The way I am reading this, if his name is not on any official paperwork yet then you do not have a legal contract with him. And put a call in or better yet, show up in person at the local police department or parole office to voice your concerns. At the least that establishes a paper trail of where he is and who knows, he might be hiding out from his PO too.

We haven't signed any lease to this guy, like I said this just took place less than a week ago, and they've fought before but made up, so my thoughts were they would do that again, but it's not looking like it. So, now, I do have to deal with this guy in an official way.

Funny how liberals are all for the release of convicts on any and every legal excuse imaginable until....

One point of view that hasn't been represented here is that this might be a good dude not to piss off. Seriously. If he pays his rent, he's a sleeping dog. If you evict him on a bad day, he could bite.

If hes a criminal, im sure hes kept on a tight little leash by his parole officer.... Let them do the legal work and you well..

Stop googling people... and pay for a background check like normal people... .who want to violate other peoples privacy.... If he is a criminal... it will show up...

Well, first off I was googling, because of an event (non-criminal), that involved him. So, I wasn't even looking for criminal behaviour in the first google, actually the result was bing, but I call all searches googling. Whichever.

Second, when you wish to enter a contract with another person, it is reasonable to expect them to look into your otherwise private information, especially information that is available via google, and various government court record sites. So, whatever.

And if you feel murder convictions, especially ones followed by heinous mutilation of the corpse, and fraud, is immaterial to judgment of character, well, you keep it up.

If you don't believe I don't care, I've been posting up here for years, and I don't think I have a history of posting attention getting fabricated drama posts. So, the fishy smell is probably coming from between your legs. It's okay happens to the best of women, a wholly correctable situation, just next time check yourself before blaming others.






As far as what I've learned essentially I can 100% send him packing, for other reasons not even related to the criminal background. The only concern at this point is criminal retribution.

As far as it goes I also, learned he is under investigation for another act of fraud. But I shouldn't worry about that, either I suppose. LOL. Whatever.

And if you think I'm just hating on felons, I'm not I've rented to ex-felons before, and got along fine. The difference was they were upfront about it, two, it didn't involve cutting bodies into pieces. For fucks sake.

No, unfortunately, I died about 2:00 last night, the cause of death is still undetermined but foul play is suspected. There was evidence of a struggle and trauma to the base of the skull, it is unknown if that was the primary cause of death, or a secondary injury due to an unknown medical condition.

I will update about my death as details become available.

.......... hehe.

The lease is your friend -- i hope.  First of all, if his name is not on the lease, he is not responsible for the rent -- the renter is.  Second, unless your lease allows for subleases there is no need for you to allow him to remain - and if the renter has actually told you that he -- the renter -- is gone and not going to live out (no pun intended) his lease at the apartment and you aren't expecting him to pay the rent, then you can agree to cancel the lease between yourself and the actual renter -- thereby making the man staying there trespassing if he doesn't leave.

If you have agreed to allow him to stay there, you should have him fill out an application and have him pay for a background check (i presume you do this for all your renters).  Tell him that the sublease is contigent upon him passing the background check.  And if he lies on the application or the criminal conviction comes up you can tell him you will not sign the lease and he has 5 days to vacate the premises.  The background check will also tell you if there are any warrants out on him for violating his parole, escape etc.

But all in all, contact an attorney, you want to make it all very tidy legally.  Also, you can simply call the renter and ask him if he is aware of this guys background and if he is, you may be able to terminate his lease due to not being honest with you as to whom he was subletting too.  He should have as the renter an obligation to be forthcoming with such information even if you allow subleasing - the sublease i believe still goes through your office.

Before you panic however, the guy may not give you any trouble in leaving.

I don't even think you have to go there, you didn't contract with this paticular individual did you? The "company" that signed the contract was not the current one. Correct? Commercial leases for companies aren't necessarily the same as private residential leases. The typical responses to landlord/tenant issues may not apply. Did you talk to a local attorney?
