Census workers can enter your apartment in your absence Bob Barr
May 28, 2010 Thousands of census workers, including many temporary employees, are fanning out across America to gather information on the citizenry.  This is a process that takes place not only every decade in order to complete the constitutionally-mandated census; but also as part of the continuing “American Community Survey” conducted by the Census Bureau on a regular basis year in and year out. What many Americans don’t realize, is that census workers — from the head of the Bureau and the Secretary of Commerce (its parent agency) down to the lowliest and newest Census employee — are empowered under federal law to actually demand access to any apartment or any other type of home or room that is rented out, in order to count persons in the abode and for “the collection of statistics.”  If the landlord of such apartment or other  leased premises refuses to grant the government worker access to your living quarters, whether you are present or not, the landlord can be fined $500.00. That’s right — not only can citizens be fined if they fail to answer the increasingly intrusive questions asked of them by the federal government under the guise of simply counting the number of people in the country; but a landlord must give them access to your apartment whether you’re there or not, in order to gather whatever “statistics” the law permits. In fact, some census workers apparently are going even further and demanding — and receiving — private cell phone numbers from landlords in order to call tenants and obtain information from them.  Isn’t it great to live in a “free” country?

You said constitutionally authorized Census. Well how is it constitutional if they are counting illegal aliens? The primary reason for the census is to provide representation to legal citizens. If they don't even have the right to be on American soil, how on earth could they possibly be entitled to representation???

Point out to me where in the constitution it mandates that any other information should be gathered. So the current census they are conducting is unconstitutional on 2 levels.

By the way, my census worker came by for the 7th time, and his supervisor one time. They have no idea who they are up against. I already disconnected my doorbell, and I'm prepared to outlast him all summer long if necessary. They aren't going to interrogate me in an unconstitutional census.

It's going to be hotter than hell this summer while he sits in his car down the street. While I'm comfortable in my a/c watching my tv.

Yes, this is how I get my jollies.

If you want to live in a country "free" from government interference, just move. Try Somalia- they have no government worthy of the name- and see how that works for you.

Also, given that Bob Barr is a former Libertarian party candidate, maybe you should look up some less-biased sources. I'm sure there's info on the Census' own website as to what census takers are allowed to do or not.

PA, this is total bullshit. Where do you find this idiotic crap? Don't you ever look at any of this shit and say, "Wait a minute, that doesn't sound right!"? That is just an absolute, fucking lie. Census workers have the same legal access to apartment buildings that a postal worker would have, in that a property owner or manager can not deny them access to the common areas of the building - as in the hallway, not the fucking apartments. Enumerators are not even allowed to open the screen door of a house in order to knock on the main door, they're sure as hell not allowed to pass through the door, for god's sake.

More bullshit. Enumerators are allowed to ask a landlord for that information (if they are unable to make direct contact with a tenant) and the landlord has the prerogative of sharing it or not, depending upon their privacy policies or whatever mood they happen to be in that day. Use your head, man.

I made them come and get me. I talked to the guy. I answered only one question that many would not, that there was no mortgage on the place and explained to the guy that I only answered it because of current conditions -n that is what has happened in the banking industry. Other than that I refused many answers. No problem.

No problem really.

But if the OP is true, it's a bunch of bullshit because the same document that allows the census prohibits unwarranted search and siezure. Not that there would be siezure, but the word search is in there somewhere. Here, they would be rolled up in a carpet and thrown down the hill.

§ 223. Refusal, by owners, proprietors, etc., to assist census employees

Whoever, being the owner, proprietor, manager, superintendent, or agent of any hotel, apartment house, boarding or lodging house, tenement, or other building, refuses or willfully neglects, when requested by the Secretary or by any other officer or employee of the Department of Commerce or bureau or agency thereof, acting under the instructions of the Secretary, to furnish the names of the occupants of such premises, or to give free ingress thereto and egress therefrom to any duly accredited representative of such Department or bureau or agency thereof, so as to permit the collection of statistics with respect to any census provided for in subchapters I and II of chapter 5 of this title, or any survey authorized by subchapter IV or V of such chapter insofar as such survey relates to any of the subjects for which censuses are provided by such subchapters I and II, including, when relevant to the census or survey being taken or made, the proper and correct enumeration of all persons having their usual place of abode in such premises, shall be fined not more than $500.

ingress 1) n. entrance. 2) the right to enter. 3) v. the act of entering. Often used in the combination "ingress and egress" which means entering and leaving, to describe one's rights to come and go under an easement over another's property.

This law speaks to the requirement of landlords to allow entrance to apartment complexes so they can knock on doors. Mine is a secured building. Without the landlord allowing access to the hallways, there is no way for the Census Worker to access the doors to knock. ( i sorta like that). It does not grant them the ability to enter my apartment itself without a search warrant. The landlord is opening themselves up to a lawsuit.

Congratulations on your heroic attempt to subvert the system, Jeremiah Johnson. I hate to burst your bubble, but all you're doing is wasting your own tax dollars - which, I believe, is one of the things you frequently rail about. It costs around $60 - $80 every time someone comes to your door. So you've just pissed away around $500 of the federal budget. As a fellow taxpayer, allow me to be the first to thank you for wasting my money like that.

And are you seriously crazy enough, and grandiose enough, to think they're going to spend the whole summer sitting in their car staking out your trailer home? There's  a procedure to deal with pseudo-libertarian tin foil hat loons, and it doesn't involve sitting in their car for weeks on end. They just go to one of your neighbors and ask him, "Hey, what can you tell me about that goofy fucker across the street who never opens his door?" Interview completed, they're done with you.

um, i have a friend who's a census taker, and the only thing he has done above and beyond go to people's doors and ask is go to city hall and get information on the weirdos who refuse to answer the door. it's not common practice, at least in kansas (where he is), to enter someone's apartment in their absence. i'm also not sure what relevant info entering someone's apartment would tell you, really. he -can- however go to the landlord to get entrance to a building, as tazzygirl said.
