I just need to vent. This morning I went to social security because I recieved a paper regarding my sons disability. It said it was being discontinued b/c I didnt turn in a form. So I made sure to take all of my income verification, and other basics with me today. I was glad I did b/c it was needed. However, the case manager pointed out that in the system someone had entered that my son only received $300 child support a month when he gets twice that a mth and has since my divorce. When I moved to Maryland I had to give disabillity a copy of my child support order.

So now they are saying between 2004 and now I was over payed almost 11 thousand dollars. However, he said that if the child support had been entered corrrectly there would be no overpayment. So I have a form to fill out and I have to take in ALL the papers I have ever gotten and filled out for them since 2004 to proof that I reported the proper amount. Once I turn those things it they have to be reviewed by the supervisor who will decide if there was an over payment or not and if there was if it was my fault. If he / she decides it was my fault (or that it wasnt their fault) then they will take money from my sons disability every mth until it is paid back. At that time I can appeal the decision and hire an attorney. I feel overwhelmed. I was already dealing with housing issues and ex issues, now this. I told my payed friend today that I felt like I was drowning in stuff that was out of my control. EDQ2 told me I will get through this, that I just have to go through the motions. He told me not to expect the worse but how do I do that? I mean ... this is all so frustrating.

I feel for you...I really do...in my last department I worked in a children with disabilities team and experienced far more what families have to battle with at times with caring for/looking after a loved one...hope that they suck it up, considering it was their fault...though over here...I guess my previous department would claim it back...best wishes for your outcome

Wow! That is very frustrating Inked. I'm sorry you're having to jump through their hoops in order to get this straightened up. You come across as a very strong person. You will make it past this challenge! [:)]

That is just some INSANE frustration, Inky!!! Take it one piece of paper at a time, and take careful notes of all conversations--who, when, what!

The bottom line is there was an over payment due to someone's mistake and of course they will try to prove that you made that mistake. If you can somehow prove that you did in fact report the truth, they can't get you on that, but because of the mistake, you were paid more money than you should have been and the paperwork you have somewhere shows that you have agreed to the overpayment considerations when you signed up or got approved.

The social security agency is known for making 'mistakes' and most of the time you don't have a way to prove much of anything the way they work. Even if you scan everything into your computer, you can't prove you sent it or all of it. You can try doing things online, but even there, I am not sure you can prove everything.

What I have done is number all pages sent to them. I scan it all and I have mentioned on one page, an attachment or comment page added to their forms. If I attach anything, it is mentioned elsewhere. I do believe that filing things online may be a bit of protection and you can scan documents in and maybe add them to their forms, but I don't know. I am also considering sending documents to them with some proof of what I sent notarized and sent in some manner that the post office or I have record of the documents being delivered. If you hand deliver them, I would still consider being able to prove all you brought in, by at least asking them to copy them all and give you a copy with a time/date stamp on each page. If you can afford to, do it before you go there in case you don't get to see someone and have to drop them off. You have to be proactive/protect your ass with them.

Wait until they move things from one office or department to another and the other never gets them! There isn't anything you can do about that one and it almost cost my son his approval in time to save us because I could no longer afford caring for him on my own. We were one month from homelessness after a two year battle with a struggle with paperwork. He should have been approved the first time because he needed total care. You almost have to do their job for them.

Because they say you don't need a lawyer until they have decided, doesn't mean you can't go get some legal counsel to ease your mind and I would recommend it. Just a bit of a consultation.

I make sure I get copies and reciepts for EVERYTHING I turn in to them. I learned the hard way. I found the paperwork from the last review a yr ago where I put the childsupport the correct amount , i even went back further and have the original from when I transfered it to Maryland in 2004 when they say the over payment started. I filled out the booklet they gave me today (in black ink as instructed). I admit I am frustrated and kind of pissed off by this. To them this isn't a big deal, I was told well we only will take 80 a mth till its paid back but the point is my son shouldn't be paying for their mistakes. Even the paperwork (receipt) they gave me today had wrong information on it, so tomorrow I have to make sure they fix that as well. Its information I gave them today. -sigh- Its annoying but it is what it is.

It doesn't help going to the social security office has caused me to have an anxiety attack every time I am there. So it adds so much to my personal disorders and issues and they dont get it or care.

ETA: thank you all for your support and advice my life is crazy right now and being able to vent here is wonderful
