The Supreme Court passed down a ruling in reference to gun control Tuesday.

quote:

WASHINGTON – State or local gun laws that prohibit people from carrying firearms outside the home and onerous registration requirements are the most likely to be struck down by judges following the Supreme Court's latest decision supporting the right to keep and bear arms.

An explosion of cases will keep courts busy for years defining gun control's new limits now that the high court has ruled that wherever they live, Americans have a right to possess guns, at least for self-defense in the home.

Justice Samuel Alito, author of the majority opinion Monday, dismissed "doomsday proclamations" that all gun laws would be struck down. Alito essentially repeated the formulation used by Justice Antonin Scalia two years ago that the court was not calling into question "long-standing prohibitions on the possession of firearms by felons or the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings."

The above part was ine ruling. Below, the writers assessment and the challenges facing many laws over the nation according to legal experts.

quote:

But the justices left a lot of ground for other courts to cover in determining the constitutional limits on gun laws. Legal challenges already are pending against several state and big-city gun laws.

Among other laws already facing lawsuits or expected to be challenged:

_Age limits that bar people younger than 21 from buying or owning guns.

_Lockbox and trigger-lock requirements to keep guns away from children.

_One-gun-a-month purchase limits in California, Maryland, New Jersey and Virginia.

_Georgia's prohibition on carrying guns into churches.

_Bans on guns in bars.

_California's outlawing of certain handguns.

_Assault weapons and ammunition bans.

_Federal and state prohibitions aimed at keeping domestic violence offenders from having guns.

Now, here is my question in regards to all this. I do advocate the right to bare arms. I do however also advocate the rights of the states over federal government, to a point.

Has that point been crossed by this ruling?

No, they ruled that no matter where you live you have the right to own firearms for protection.
You'd just figure that big cities that are much more dangerous than suburbs and rural areas would "allow" people to excercise their rights but the exact opposite has been the case.
And Chicago Mayor Daley is frantically writing (new) laws that are contradictory to this new ruling already such as only "allowing" one gun per household!
The politicians just don't get it, they can't "allow" the excercise of one's rights!
Yahoo News had an article about Daley the other day, what an idiot!
Violent crime is so bad in Chicago that they want the National Guard there but, Daley doesn't people to be able to excercise their rights and carry guns to protect themselves?
Again, big cities are where you need to be carrying a gun!
And once again, politicians shouldn't be trying to *dictate* to The People!
Is this deuschbag up for election in November?

Tazzy, of course it does, it's just that it happens far more often in big cities.

Ok, lets take this part of your post. Which rights are you referring too, the one to bear arms per the consititution?

What, you mean where they have massively higher populations than in some one horse town in the sticks? Whyever would that be the case?

I expect the government will make a major move towards restricting gun ownership very soon. Falling consumer confidence (codeword for increasing poverty), increasing unemployment, underemployment  and coming austerity measures ( =eliminating social safety funding ) could potentially lead to riots. We saw in Toronto 1 billion spent to protect small delegations of 20 countries from peaceful crowds. Imagine much larger angry crowd armed with firearms. They will find a way how to bypass the Constitution.

The USSC just refuted that statement loud and clear. Do you ever think be fore you post?

Doesn't matter, Jeffff.  Even if the Supreme Court says one thing, the politicians will try to strong-arm their way into some ridiculous decisions.  It happens all the time from both sides.

And it will go back to the courts. It may indeed take a while to get there but it will get there.

I may be wrong, but I believe there are only 3 states that do not allow concealed carry. Illinois is one of those. Many states have passed  laws  allowing it over the last 5 years because of unbiased studies that show gun ownership does in fact reduce crime.

The court has a long history of liberally interpreting the 2nd Amendment. It is always possible that that could change. It is hard to imagine it changing in the near future.

Well, the fact that the second amendment is seen as covering anything besides breech loading muskets is a liberal bit of interpretation from the off, isn't it?

unbias studies?

Yes, a few of those were funded by organizations with ties to the NRA. I'm sorry, but in all fairness I can not accept a study, that comes either directly or indirectly from the NRA, as being 'fair' and 'honest'. They just dont have good credibility. Since, most conservatives believe the NRA serves them. Which is amazingly, not the case. The NRA doesn't represent Americans out of the goodness of its heart. Nor, the protection of the last nine words of the 2nd Amendment. No, they represent the GUN INDUSTRY. That's right boys and girls, they respresent the guys who want to be able to sell their products and services much more to consumers at large. Whether those consumers are 'law abiding citizens' or criminals. Less regulation, rules, and inspectors. Metaphorically, its like the Oil Industry's regulators and inspectors. And look what happen to those red states in the Gulf of Mexico...

However, before the conservatives jump for joy, they might think about what the ruling says. If the 2nd Amendment over-rules, state laws and rights, then it would be fair to say, gay marriage should go through on the basis of the 1st Amendment. Or Arizona's newest immigration law, is unconstitutionaly under the 4th Amendment. Sorry conservaties, you dont get it both ways. Its either: "The Federal goverment is all powerful" or "States Rights are the law of the land". Not both! You dont like it, when us liberals try to get away with it, the same also applies to you!

It has been the observation, that conservatives, in their quest for more power, fame, and money; often ignore the wisdom of their words/actions over the long term. As such, they keep suffering problems that could have been solved by simply thinking 'down the road 20 years', instead of 'two years'.

It is going to be really interesting watching how this ruling affects Chicago.

They already counted the cemetery vote. He wins. I think he's also looking for a kickback from the lawyers who will be suing about the onerous regulation, because there seems to be plenty of that.
