The case was watched closely by both supporters and opponents of same-sex marriage, as many say it is likely to wind its way up to the U.S. Supreme Court. If it does, the case could end in a landmark decision on whether people in the United States are allowed to marry people of the same sex.

I am a citizen of California. We have many activists that have worked against the forces of bigotry and hatred against the LBGT community. I have signed petitions, bought tshirts against prop 8 when it was on the ballot, etc etc etc...

California has a culture war, the rural against the urban, the coast against the inland, the educated against the not-educated.... The sad thing is many minorities voted for prop 8 because of cultural bias against homosexuality. Latino voters voted for it, black voters voted for it, and since Obama's election got a lot of first time voters from minority communities, the aftermath was this proposition, even though most Californians are not anti gay rights.

rob, the ruling was stated in such a way as to force a SC ruling. And the ruling has a hold, pending all the contests.

I think even the Judge is seeking a Supreme Court ruling. By declaring the law unconstitutional, it seems that is where all this is heading.

Not the majority of voters but the majority of those who voted.
You seem to be unhappy that the will of the majority of those who voted could not overule the constitution

Our Constitution guarantees the rights of the minority in the face of oppression or discrimination from the majority. Our Constitution (in a not so legal term) overrides ANY law created by a majority when it it's in direct conflict with the Constitution. Our Constitution guarantees "liberty" for all and in some kinda related document there's some phrases like "inalienable rights", "pursuit of happiness", and "all men created equal".

This judge wasn't "smashing" the majority vote, he was upholding the Constitution. What's your objection here?

I'm detecting a certain bitterness here...

The thing I always find hilarious about this debate is the way that it's mostly the same demagogues who are constantly whining about the terrible promiscuity of gay men* and the terrible threat they pose to your nation's youth just by existing and having a timid itch for a bit of cock now and then who are also desperate to prevent gay marriage. Now maybe it's just me, but might these idiots be confusing the cause and the effect (at least to the tenous extent that anything they have to say bears any resemblance to reality)? That's a demand to have it both ways an order of magnitude or two greater than anything the glbt community wants, frankly.

*(It's always gay men these cretins spend their time whining about. Presumably as somewhat inhibited religious hypocrites, they're just as keen on lesbians as most other blokes.)
