This is just incredible.

CHICAGO — The federal jury that found former Illinois Gov. Rod Blagojevich guilty of just one count of lying to federal agents was deadlocked 11-1 in favor of convicting him of a more serious count involving an alleged attempt to sell a Senate seat, a juror said Tuesday.

Juror Erik Sarnello of Itasca, Ill., said one woman on the jury "just didn't see what we all saw." The 21-year-old Sarnello said the counts involving the Senate seat were "the most obvious."

Really this happens all the time. People say we shouldn't put up with it. I agree. Got any ideas ?

The fact is there are two sets of laws, and that is the crux of the matter. And no matter what, the defense could always assert that there was no law specifically banning the deal he would've made, had it not become public. It is an easy defense to pick apart the words of the written law and say that nowhere in that law does it specifically prohibit [this] action.

How many times would you suppose this has gone on behind closed doors with noone the wiser ? When  one gets caught, many others may have done it before. In fact it is the assertion of most courts that if you got caught once YOU have done it before, like in a DUI case or something like that.

Really, the defense was probably brilliant. But when you can afford it you can have it. I've had people up and down how they spent ten grand on a lawyer, but I know that only buys you someone greedy sometimes. But when you get into six figures you are likely to get a good deal on something like this.

Look at OJ Simpson. Anyone without that kind of money would have never walked. We all have known that for years.

That is how justice works in this country.

I find it interesting that there was only one hold out on all the other charges. 11 - 1.

Mostly we get the best justice money can buy. Our courts are loathe to actually do the job and rule according to facts and law - unless you can threaten them with a high powered attorney. The media can also be used as threat to the judiciary.

We really haven't come very far. We're still involved in nothing more than single combat, and whoever can hire the biggest bully wins.

The case was a mess.

Was Blago a sleaze? Definitely. Had he actually done anything illegal? After the SCOTUS ruling on theft of honest service it was pretty clear it was going to be hard to make anything else except for the obstruction charge.

He's guilty of obstruction and retrying him on the rest strikes me as a waste of resources but I don't make those decisions for the feds.

There are other things. One, if innocent you can present your evidence in a more public way. Even if guilty of a victimless crime (which doesn't exist) you can put it out there by filing your information with the clerk of courts. That is alot harder to quash. You just have someone retrieve those documents before the court date, pay for the copies and there will be a record.

But always remember you can only impel them to operate under the Constitution by threat of embarrassment. These lower courts know that it is rare for an appeal for example to have the records sealed. Even marking the transcript "Not to be cited or published" doesn't always work. But if you robbed a bank you are screwed.

In short, if you created a victim you are going down and the best thing is to make nice with them and cut the best deal possible. That's the game.

Really it's best just not to piss them off. All this can be incredible expensive and most of us just can't do it even with the money. I could refer you to the Trafficant case for more details. The fact is they did not like him, and see what happened.

But in the case of Blago, they probably got into judge's chambers and made a deal in the end. "Look, you got 11 to 1 this time and we can try you again, and you might not be so lucky". That is not part of the official record. There were probably five people in that room and if none of them opens their mouth we will never hear about it again.

That's the justice system.

How many people with far more money than Blagojevich are in prison right now?

Bernie Madoff, Dennis Kozlowski, John Rigas.  Should I go on?  Because there are plenty more.

rmy, you just don't get it. Money is a big part, but there is much more to it. It's how they see you, as on their side or not.

It's like a game of Monopoly. You can get a chance card that says "GO DIRECTLY TO JAIL,  DO NOT PASS GO AND COLLECT $200", but you can buy a "GET OUT OF JAIL FREE" card. It is not against the rules. But the other players can refuse to sell. Look at John Gotti, they made a special law just for him.

They make the rules.

If I am understanding you about who "they" are then why do so many of them end up in jail?

Well, you are entitled to your opinion. But I think if you did some unbiased research you wouldn't come up with numbers that support your position.
