Rule -> Avatar "theft" (4/24/2006 4:48:18 PM)

Hi,

I looked for an avatar that fits me and ultimately I decided on this one.

Today I got this message:

"Just a quick note - i had been using the Avatar that You chose, on the message boards. Then one day You have it. i know there aren't any rules, but would You mind choosing a different Avatar since i had this one first? Thank You "

What should I do? I chose this avatar very carefully without the intention of stealing it from another person. It will be difficult to find another avatar. Also that person already uses another beautiful avatar. If it was possible for me to appropriate her avatar, then why does she not simply appropriate it back? Is it possible to appropriate the avatar of someone else? And if I do choose another avatar who is to say that I will not next get a complaint from someone else that I then appropriated his or her avatar?

murmur -> RE: Avatar "theft" (4/24/2006 4:50:59 PM)

go in the archives and pick an avatar from someone who stopped to post or who's last post was for a long time ago...you'll not get any complaints then[:D]

You didn't steal their avatar. You both have the same avatar, that's all. You are certianly within your right to keep the avatar, they have no claims on it. It belongs to the collarme site and it's there for the use of any and all members.

I second that.  If they're there for general usage, feel free.

Especially since the other party is not even using it anymore....takes a lot of hutzpah to ask you not to use "their" avatar!  They'll get over it.

ToServeIsToLive -> RE: Avatar "theft" (4/24/2006 7:48:50 PM)

I believe the pigeonhole principle shows that some people on this site will have the same avatar... Not much you can do about it.

BitaTruble -> RE: Avatar "theft" (4/24/2006 7:50:01 PM)

The thought you put into your choice of avatar reflects what it means to you. I'd point that out to the person who emailed you and compliment them on their taste, but I would not give up what means as much to me as it did to them. No one has a claim here and if they did, I'd say your claim is the stronger one anyway, since the other person discarded that avatar for something different.

Don't worry about it.

If the picture was compiled by the person who wrote you, I'd understand hir irritation, but because we can't import our own anymore, there's bound to be some overlap.

I'd probably send a nice note to that effect back.

juliaoceania -> RE: Avatar "theft" (4/24/2006 7:52:29 PM)

I had someone tell me that our pics become the property of collarme when we post them on their website, it is the reason I took mine down. Is this true? I do not want my pic to come up in searches on google related to collarme

Lordandmaster -> RE: Avatar "theft" (4/24/2006 7:56:15 PM)

Well, OK, but I'd be annoyed if someone else started using my avatar of two elephants fucking.

Give it a lick, then she won't want it back. [:D]

If it bothers you, there are a number of icon/avatar sites out there where you can find images not archived here on Collarme. They're more likely to be unique, although I do think Collarme draws from at least one of them for its collection.

I would be annoyed too. I see those fucking elephants and I know it's Lordandmaster posting. [:D]Just like many of the other avs I identify with certain posters. I wouldn't really like it if someone used my shoe av because I have had it for awhile and it feels like mine.

I say keep the av if it makes you happy. But, if you do want people to really get to know you for you then maybe you should pick something else. It is a very cool av though!

Aileen68 -> RE: Avatar "theft" (4/24/2006 8:15:27 PM)

I've seen a lot of posters using the same avatars.
It throws me off sometimes because I'll see the avatar and think it's one person posting
and then I look at the name and realize its someone else.
But they don't own them and you have every right to pick whatever avatar you like.

And LaM...where did you get that pic?

LuckyAlbatross -> RE: Avatar "theft" (4/24/2006 8:23:50 PM)

We're limited to self-expression online.  When I used to be in chat rooms, it was quite common for a regular to "claim" a type of font and if a newbie came in, they were asked to change.

While I understand the desire to be unique, special, and to have some "claim" on something as your own- the point is that if you pic something from a bank of pictures, then you accept that others might choose that as well.  Making someone else feel obligated to you is definitely uncool.

And of course I can understand the feeling of a faux pas.  When I switched from EmeraldSlave2 to LuckyAlbatross, it never dawned on me that people might shorten it to "LA" which was ok except for the fact that we had LadyAngelika who also often posted and was also shortened to "LA" often.  When both of us popped on, it could get confusing and I did feel a twinge at the idea that I had caused some confusion and taken away some sort of identifier for her.

But you get over it, it's just an online nick, everyone knows who is who, you act graceful about it and life moves on.

It bothered me the first time I saw my avatar on here being used by others, too, so I empathize. But, that's the nature of forums. I'm glad I have the option of putting up my photo, at least that way I have every reason to expect that no one will share it.

I love your avatar by the way. Sure miss LROD though. LOL

What should I do?

There are more people here than choices for avatars and unless someone chooses to use their profile photo as their avatar, there is always the possibility that multiple people will choose the same 'free' avatar.  Keep it or change it as you like but don't feel pressured to do so because of another user's request.

sylphgossamer -> RE: Avatar "theft" (4/24/2006 10:14:47 PM)

while it's very annoying (the same thing happened to me; i carefully chose one that nobody was using and which completely personified me and how i look--very small body, auburn hair, thin tiny wings). i posted a few posts with it and then suddenly i noticed another using it, and now there is a third...confuses the heck out of me when i see them and think it's me), it's far worse to have your profile photograph pilfered by others on this site. that's quite out of line to say the least. i've had that happen lately, too. sheesh. nothing is sacred to some.

That has got to be illegal. Whomever has their picture stolen needs to write to support on the other side and have the profile pic removed.

Rule,

If you can get CM to upload an avatar or you I will happily make you what you want.

Geesh - i simply asked if you wouldn't mind choosing a different avatar since i had this one. OMG - i can't even imagine what you're like with a REAL problem. whaaaaa

Lordandmaster -> RE: Avatar "theft" (4/25/2006 10:59:05 AM)

I don't have too much sympathy, Submotive.  There aren't enough avatars to go around.  Mathematics dictates that some avatars will have to be used by more than one person.
