Is .08 DUI, same for Public Drunkedness

A buddy wants to walk home - go to a bar in her town.  She is afraid of being arrested walking home.   Is the DUI .08 for that standard?

According to Pennsylvania Crimes Code - Title 18 and the Pennsylvania Vehicle Code - Title 75:

Title 18 Section 5505 Public Drunkenness A person is guilty of a summary offense if he appears in any public place manifestly under the influence of alcohol... to the degree that he may endanger himself or other persons or property, or annoy persons in his vicinity.
Penalty: 1st Offense - Fine - 0-$300 - Jail - 0-90 days
There doesn't seem to be the same alcohol level used to determine public drunkeness as with driving while intoxicated.

unless she is being obnoxious and disturbing the peace, i don't see why cops would bother her.  If they see her walking home by herself and she seems disoriented they may stop to make sure she is okay or even just because she is a female walking alone late at night they may ask her if she is okay.

Also, why can't you go get her or have her take a cab home?  Personally, to me if she plans to be intoxicated walking home by herself is not the best thing she could do for safety reasons; she would be better off calling a cab.

She has a ride for now.  (as far as we know the ride will continue-  )

We were debating if she wanted to pay a membership at that club.   She would be committed for a year if she does.

If she is concerned about the ride, just make sure to call a cab company and find out if they will pick up and take her home where she is going as a backup plan or you be her backup plan.

I don't advocate intoxicated women walking home alone in the dark.  Their senses are too out of wack to be aware of their surroundings and that is dangerous.
